<br />for his disciiarge as Executor, aria the evidence, and was submitted to the Court,.,

<br />on consideration aereof, , tie Court finus triat due and legal notice of this hearing was had
<br />by publication according to law.
<br />j The Court further finds Viat said Ellen S. Sanborn departed V-1is life, testate, in the City
<br />of Hastings, Nebraska, on the 13th day of September, 1916, and at t,ie time of her death was a
<br />resident of and domiciled in Adams County, Nebraska;
<br />That on the 30th day of September, 1916, a paper writing, purporting to re the last Will and
<br />Testamert ,of said Fllen S. Sanborn, deceased, was duly filed for probate in this Court; said Will
<br />reing it words and figures following;, to -wit:
<br />Last Will and Testament of Ellen S. Sanborn
<br />I Ellen S. Sanborn of the City of Hastings, County of Adams and State of Nebraska, consider -
<br />ing the uncertainty of this mortal life, and being of sound mind and memory, ao make publish and
<br />i
<br />declare, this to be my last will and testament, to -wit:
<br />FIRST. I direct that all my gust debts and funeral expenses be first paid.
<br />SECOND. I give, devise aria bequeath all the rest, residue and remainder of my property both real
<br />and personal, to my husband, Charles S. Sanborn, to nave ana to hold to him my said husband and
<br />j to his heirs and assigns forever.

<br />We lxhose names are hereunto subscribed, do hereby certify that Ellen S. Sanborn, the testator,
<br />subscribed her name to this instrument, in our presence and in the presence of each of us, and
<br />declared..at the same time in our presence and hearing that this was her last will and testament,
<br />and we at her request sign our names hereto, in her presence as attesting witnesses.

<br />j and decree was duly entered, proving, approving, probating and allowing said instrument as the
<br />last Will and Testament of saia Ellen S. Sanborn, deceased, and Letters Testamentary were duly
<br />issued to said Charles S. Sanborn, Executor, wLio was then duly appointed Executor of said estate;
<br />that he dul -y qualified as such, and on that date oecame,has been ever since and now is the duly
<br />appointed, qualified ana acting Executor of said estate;
<br />That on the 28th day of October, 1916, an order was duly made and entered, ana notice triere-
<br />of jiver:, fixing the 2nd day of Decer:iber, 1916, at ten o'clock A.M., or within six months taere-
<br />after, as the tulle for filing claims ana directing V-iat notice be given 'thereof according to law;
<br />t.1at thereupon notice to creditors was duly given and published as required by law.
<br />The Court finds t:aat all debts, claims and demands against said estate aria the costs of ad-
