<br />ivow on this 27th day of June, 1917, this cause came on for hearing, upon the final report an
<br />petition Of William H. Marka, Junior, and Richard L. Marsh, Executors of said estate, for a settl(
<br />ment thereof, ana it appearing, from the proofs on file in this Court, that due and legal notice
<br />as by law and the orders of this Court required, had been given to all parties interested in said
<br />estate, of the filing of said petition and report, and of the time and place for hearing thereon,
<br />ana there being no objection thereto, tae Court, upon examination thereof, finds that said report
<br />Is in all respects correct ana should be allowed ana approved.
<br />The Court further finds from the proof on file in this case that due and legal notice, as
<br />required by law and the orders of this Court, has been given to all persons having claims against
<br />said estate, of the time and place for filing same, ana that said time has expired, and that all
<br />debts of said estate, and upon which it is liable, together with costs of administration, have be(
<br />fully paid, and that all other claims or debts thereof, if any exist, are forever barred and pre-
<br />cluded.
<br />The Court further finds, from the proof on file herein, aria from the evidence of said execu-
<br />tors in support thereof, that the claim filed by the Bank of Doniphan, of Doniphan, Nebraska,
<br />against said estate, in tae form of a note signed by said deceased, and -Samuel B. Marsh, in the
<br />name of S. B. Marsh, was in fact the debt of the said Samuel B. Marsh, one of the legatees and
<br />visees of said deceased, and trZat by an agreement between said executors and said Samuel B.Marsh,
<br />the amount coming to him under distribution from said executors was applied in the payment of sai
<br />note and interest thereon, and that said note has been fully paid, and a receipt of said Rank, as
<br />Claimant, filed herein, together with the written consent of said Samuel B. JvTarsh, for the use of
<br />his distributive snare in the payment thereof, and his receipt for his said distributive share
<br />from said executors, so applied.
<br />The Court further finds that the said deceased died seized of tfte following described real
<br />estate situate in Hall County, Nebraska, tcwit:
<br />The west 153 Peet of Lot Two (2) of the County
<br />! Subdivision of a part of the South half of Section Five (5),in Township Nine (9), Range Nine (9),
<br />west, Nall County. Nebraska.
<br />Also, a piece or parcel of land described as fol-
<br />lows: Commencing at the northwest corner of Lot. two (2) of the County Subdivision of a part of
