<br />Now on this 26t1ft day of May, 1917, this cause came on for nearing upon the final report of
<br />Clara L. 74arks, executrix of the last will and testament of Elmer F. Marks, deceased.
<br />on consideration of the files and records of this office, and of the testimony, the court
<br />rinds that notice of the filing of the final report of said executrix and of the time and place
<br />appointed for final settlement of the estate of Elmer F. Marks, deceased, has 'been given to all
<br />persons interested by publication as required by law and the order of this court, dated May 12th,
<br />1917; that no objection or protest has been filed against the allowance of said report; that aft
<br />full examination, the court finds that said report is correct in all respects and ought to be al-
<br />..lowed, and that the executrix has accounted for all of the estate which came into her possession,
<br />land that there remains no money or other property in her hands for distribution.
<br />Tne court finds that tae said Elmer F. Marks, departed this life on the 3d day of Janu8,ry,
<br />1916, being at tae time of his death., a resident of Hall County, Nebraska, and that he left a last
<br />;will and testament, which instrument was duly proved, allowed, and admitted to probate in this
<br />court on the 14th day of February, 1916.
<br />The court finds that the said Elmer F. Marks was at the time of his 'death, the owner in fee
<br />of the following described real estate, to -wit:
<br />An undivided one - seventh interest in and to the
<br />Southeast quarter, (SFF4) of Section Twenty- Eigrit (28) in Township Ten (10) in Range Eight (S) West
<br />in Hamilton County, Nebraska, and An undivided one - seventh interest in and to Lots
<br />one (1) and Two (2) in Block Fifteen (15) in Rollin's Addition to the city of Grand Island, in
<br />Hall County, Nebraska, the interest of said Elmer F. Marks in and to both of tae above described
<br />'tracts of real estate being subject to a life estate of Villa A. Marks and John A. Marks.
