11 GLBZ <br />I M02 <br />FINAL DECREE. - <br />IN THE COUNTY COURT OF MALI, COUNTY, NEBRASKA. <br />i <br />In the matter of the estate of) <br />F I N A L D E C R E E. <br />Diary Bergfleth, deceased.) <br />Now on this 14th day of April 1917, this cause came on for hear- <br />n Wiese, administrator of the estate of Mar Bergfleth deceased it <br />ing upon the report of Williar y > <br />appearing to the satisfaction of the court from the proof now on file that notice of the filing o <br />i said report and of the time and place fixed for the final settlement of said estate has been give <br />to all persons interested by publication of such notice as required by law and the order of this <br />I <br />,court dated April 4, 1917, and that no one has appeared to object to or protest against the allow- <br />ance of said report. <br />i <br />On consideration of the said report and of the files and records of this office with the tes <br />1timony submitted, the court finds that said report is correct in all respect and ought to be al- <br />�f <br />flowed; that the administrator has accounted for all of the estate of said deceased which came int <br />his hands and has paid the funeral expense, the costs of administration, as well as all claims <br />s filed and allowed against said estate and that lie has in his possession for distribution the sum <br />!Of 05439.92. <br />I <br />j! It is therefore considered and adjudged by the court tnat the report of the administrator of <br />L( <br />tree estate of Mary Bergfletn be ana the same hereby is approved and allowed as and for his final <br />Iaccount, and that upon his filing in this court the receipts of all persons entitled to share in <br />'t the distribution of the personal property for their respective snares, he be discharged of his <br />j trust and his bond released. <br />E <br />j The court finds that by order of this court dated September 21st, 1915, creditors of the sal <br />1 <br />i nary Bergfleth, deceased, were allowed 6 months from the lst day of November, 1915, in which to <br />I <br />file their claims in the office of the County Judge of Hall County, Nebraska, for allowance; that <br />(notice of the time allowed and place appointed for filing claims was given to all persons Interes - <br />E <br />i <br />ii ed by publication of such notice for four consecutive weeks in the Grand Island Semi - weekly Inde- <br />pendent; that the time allowed for filing claims has fully expired and that all claims and demand <br />of whatsoever nature outstanding against said estate and not so filed in this office within the <br />time limited for filing claims are therefore forever barred and excluded. <br />It is therefore considered and adjudged by the court that all persons are forever barred <br />from film; or setting up any claims or demands against the estate of Mary Bergfleth,deceased, an <br />said estate is fully settlea and closed. <br />1 The court finds that the said Mary Bergfletn departed this life on the 30th day of August,19 5, <br />1! being at the time of her death a resident of Hall county, Nebraska, and that she died intestate, <br />'leaving surviving her as her heirs -at -law and her only heirs -at -law, the following named persons: <br />IFdward Boltz, Gustav Boltz, Herman Boltz, Richard Boltz, Emil Boltz, Henry Boltz, R ma Moeller an <br />i Kroeger, children of Johanna Boltz, deceased, who was a sister of Mary Bergfleth; -- Rudolph <br />Kay, Charles Kay, Nancy Huebner, Minnie Kay, ana Emma Wiese, children of Henry Kay, a deceased <br />i <br />;'brother; - William Kay, Sophia Ledroit, Emma, Kay Westerfield and Minnie Hargens, brother and slate is <br />t <br />of the half blood of the said Mary Bergfletn; and Carl Stelk, son of Rorie Stelk, deceased, a s s <br />ter of the half blood of said Mary Bergfleth. <br />The court finds that the said Mary Bergfleth left no issue, no hus -band, no father and no <br />mother surviving her. <br />The court finds that the said nary Bergfleth was the owner at the time of her death, of the <br />following; described real estate situate in the County of Hall and State of Nebraska, to -wit: <br />Lot One (1 ) and the North East Quarter (NEI) of the North East Quarter (NEJ) of Section <br />ty -Three (23), Township Ten (10) in Range Ten (lo); the East Half of the South East Quarter (EJ <br />SEJ) and the North West Quarter of tae South West Quarter (NEI SWJ) of Section Fourteen (14), <br />
