�]GI BZ <br />1 <br />1 <br />u <br />1' <br />1 <br />10? 5 <br />to all persons interested by publication of such notice for four consequtive weeks in the Grand <br />Island Semi - weekly Independent, a legal newspaper published and circulating in Hall County, Neb- <br />raska; that the time so allowed for filing claims has fully expired and that all claims and demand <br />outstanding against the said deceased and not so filed, if any such there be, are forever barred <br />and excluded. <br />It is, therefore, considered and adjudged by the court that the report of the administrator <br />with the will annexed of the estate of Samuel Moll, deceased, be and the same hereby is approved <br />and allowed as and for his final account and he is discharged of his trust and his bond is release <br />It is further considered that all persons are forever barred, excluded and concluded from <br />filing:; or setting up any claims or demands against the estate of Samuel Voll, deceased, and that <br />said estate is fully settled and closed. <br />The court finds that Samuel Moll departed this life on tae 7th day of March, 1915, at :lis <br />home in Colfax, iia8per County, Iowa, and that he left a last will and testament, which instrument <br />was duly proved, allowea aria admitted to probate in the District Court of Jasper County, Iowa, on <br />the 12th day of April, 1915; that the said Samuel Moll was at the time of his aeath the owner in <br />fee of real estate situate iri tree County of Hall, and State of Nebraska, upon which said will oiler <br />ates, ana that said will was, therefore, after due notice, proven, allowed and admittea to probate <br />in tree County Court of Hall County, Nebraska, on the 7th day of August, 1916, and entered upon the <br />records of said court. <br />The court further finds that the said Samuel Moll died possessed in fee simple of the follow- <br />ing described real estate situate in the County of Hall, and State of Nebraska, to -wit: <br />The South Half (Sa) of the South West Quarter (SW1) of Section Thirty -Four (34) in Township <br />Eleven (11) North, in Range F even (11) West, of the 6th P.M. <br />The court finds that under the provisions of said last will and testament all of said real es <br />tate did pass and descend at the death of the said Samuel Moll to Rosy Evans, a sister of the tes -1 <br />tator, in absolute title. <br />It is, therefore, considered and adjudged by the court that all of the right, title and in- <br />terest of Samuel Moll in and to the South Half of the South West Quarter of Section Thirty -Four in <br />Township Eleven North in Range Eleven West, of the 6th P.M. in Hall County, Nebraska, did pass and <br />descend at the death of the said Samuel 1ka-11, unaer and by virtue of the terms and provisions of <br />his last will and testament to Rosy Evans, his sister, in fee simple. <br />J. Mullin <br />County Judge. <br />^ Copy of Will of Samuel Moll. <br />In the name of God, Amen: <br />I, Samuel Moll, of Galena, in the County,of Lawrence, State of South Dakota, being of sound <br />a disposing mind and memory, yet mindful of the uncertainty of life, do make, publish and declarl <br />his, my last will and testament, in words and figures following, that is to say: <br />I direct first that all my debts, funeral expenses and expense of last sickness shall be paid. <br />It is my wish that my remains be buried in McKeever burying- ground, Colfax, Iowa. <br />I desire and direct that my executor place a suitable monument over my grave & set apart <br />500 for this purpose. <br />I give, devise and bequeath to my beloved sister, Rosy Evans, residing near Colfax, Iowa, my <br />arm in Fall County, Nebraska, described as the south half of the south -west quarter of Section 34, <br />township eleven north, Range eleven west, containing DSO acres. <br />I give, devise and bequeath to my beloved nephew, Fred M.
