<br />The court further finds that said deceased left surviving him as his only heirs at law, the
<br />following named persons: llargaretria Catharine Stark, his widow, Heinrich Christian. Stark, his son
<br />Claus Frederick Stark, his son and Adolph Christof Stark, his son.
<br />The court further finds taut said deceased died seized in fee simple of the following des-
<br />cribed real estate, situate in the County of Hall, and State of 1�ebraska, to -wit:
<br />Commencing at a point on the south side of the alley, Fifty (50) feet in the North Easterly
<br />i direction from the North West corner of Lot No. Five (5) in Block No. Eighty -Nine (89) in the
<br />;original town, now city, of Grand Island; thence running in a North- Easterly direction along the
<br />j� south line of said alley One Hundred Thirty Six (136) feet to the west line of the County road;

<br />!thence south along the west line of said County road Fifty -One (51) feet; thence in a South-West -

<br />1froln erly direction parallel with the south line of said alley and Forty -Four (4!�) feet distant there-
<br />One Hundrea T«enty Fight (128) feet; thence in a North- Westerly direction and parallel with
<br />the west line of Block Eighty -Nine (89), Forty -Four (44) feet to the place of beginning.
<br />The said real property was an estate of inheritance.
<br />The court finds that under and by virtue of the law of descent, of the State of Nebraska, the
<br />above mentioned ana described real estate did pass and descer_d to the said Heinrich Carl Stark,

<br />Claus Frederick Stark and Adolph Christof Stark in equal shares and in fee simple, subject, now-
<br />lever, tc the right of dower and the homestead right of the scuia Margaretha Catharine Stark, widow

<br />of the deceased.

<br />It Is, therefore, by the court considered, adjudged and decreed that the said Carl Heinrich
<br />Stark died intestate more than two years prior to the filing`; of said petition; that no auministra
<br />lltion has been had or applied for upon his estate in the State of Nebraska; that he died seized in

<br />,fee simple of an estate of inheritance, situate in the County of Hall and State of Nebraska as
<br />above set forth ana described; taut he left him as his only heirs at law the said T;?argaretha Cath-
<br />arine Stark, his widow, Heinrich Carl Stark, Claus Frederick Stark and Adolph Christof stark, his
<br />sons; that said above described real estate passed ana descended to the said cftildften of the de-
<br />ceased in equal shares,- one -third to each, subject, however, to the homestead and dower right of
<br />his widow in and to said real estate and to their heirs and assigns forever, and the same is here-
<br />bygawarded to them; that all debts of said deceased and his estate, if any such exist, are forever
<br />lb arred and precluded, and that further administration of said estate is dispensea with ana said
<br />testate forever ,,,losed.
