<br />law of Joseph Roach, deceased, to be invested, and the income therefrom to be devoted to the car
<br />of the Roach family burial lot in the Alda Cemetery at Alda, Nebraska, and under the terms of
<br />said will the said Ralph R. Horth is to administer said trust until he can make satisfactory
<br />arrangement with the Alda Cemetery Association for the perpetual care of said burial lot, when h
<br />is authorized, by the terms of said will, to pay said $200.00 to the said Alda Cemetery Associati
<br />The court further finds that the said Ralph R. Horth, as such executor, has paid to Ralph R.
<br />Horth, as trustee under the 12th paragraph of the last will and testament of the said Kate S.
<br />Roach, deceased, the sum of $784.73, being the balance of the residuary estate remaining in his
<br />hands after paying legacies, debts of said estate, and costs of administration.
<br />The court further finds that all debts against said estate have been paid by said executor;
<br />that all legacies under said will have been paid and distributed, that the inheritance tax due
<br />from said estate, and the costs of administration, have been fully paid, and that said estate
<br />ought to be settled and closed.
<br />The court further finds that due and legal notice has been given, in the manner provided by
<br />law, of the time and place fi:,A-ed for filing claims against said estate, that the time so fixed
<br />has fully expired, and that all persons having claims against said estate, if any such there be,
<br />are forever barred, and excluded from setting up or asserting any claim against said estate.
<br />The court further finds that tree said Kate S. Roach died seized as the owner in fee simple
<br />of Lot Number One (1) in Block Number Two (2) in WinaolFtz's Addition to the city of Grand Island,
<br />in Hall county, Nebraska, that the said Kate S.Roach acquired title to said property in the name
<br />of Kate Sc.holey, that being her name prior to her marriage to Joseph Roach, that by the terms of
<br />the 10th paragraph of the last will aria testament of the said Kate S. Roach, formerly Kate Schole�,
<br />deceased, was given to Ralph R. Horth by absolute title.
<br />It is,therefore, ordered, adjudged and decreed by the court that the report of the said
<br />Ralph R. Horth, as such executor, be, and the same��'s, in all things, allowed and approved, as
<br />and for his final report; that he bre discharged as such executor, and his bond as such is hereby
<br />released.
<br />It is further ordered, adjudged and decreed by the court that all persons having claims
<br />against the estate of the said Kate S. Roach, aeceasea, if any such there be, are forever barred,',
<br />enjoined and excluded from setting up or asserting any claim against said estate.
<br />It is further ordered, adjudged and decreed by the court that under the provisions of the
<br />[ -last will and testament of the said Kate S. Roach, deceased, the title to Lot One (1) in Block
<br />Two (2) in Windolph's Addition to the city of Grand Islam, in Hall county, Nebraska, passes by
<br />absolute title to the said Ralph R. Horth.

<br />I, J.H.Mullin, County Judge of Hall County, Nebraska, do hereby certify
<br />that I have compared the foregoing copy of The Last Will and Testament and Final Decree in the
<br />matter of the estate of Kate S. Roach, deceased, with the original record thereof, now remaining
<br />in said Court, that the same is a correct transcript thereof, and of the whole of such original
<br />record; that Said Court is a Court of Record having a seal, which seal is hereto attached; that
<br />said Court has no Clerk authorized to sign certificates in his own name, and that I am the legal
<br />custodian of said Seal and of the Records of said Court, and that the foregoing attestation is in
<br />due form of law.
<br />IN THSTIMONY WHEREOF I have hereunto set my hand and affixed the seal of the
