32 MLL AND DEGREE RECORD No. <br />DECD : - <br />Be it remembered, That on the 9th day of September, 1916, that being one of the day <br />of the June Term, 1916, of the District Court of the 11th Judicial District of Nebraska, within <br />and for the county of Hall, held at the court house in the city of Grand island, before Honorable <br />James R. Hanna, one of the judges of the said District, tie following among other proceedings were <br />had in the words and figures following to -wit; <br />In to e District Court of Hail County, Nebraska. <br />Francis E. Grove, formerly Francis E. Hunt,) <br />-----Vs ----- <br />( 4202. Decree <br />Justus Miller, and Mrs Justus Miller, wife ) <br />of said Justus Miller,whose real name is <br />unknown, ) <br />This day came the plaintiff, in person, and by Arthur C. Mayer, her attorney, and the <br />defendants and each of them still failing to answer, demur, or otherwise plead to the petition of <br />the plaintiff, were each thrice solemnly called in open court, and came not, but made default, anc <br />it appearing to the court that the said defendants and each of them had been duly notified of the <br />filing and pendency of this action by publication for the time and in the manner provided for by <br />law, it is ordered that their default be entered herein and that the facts stated in the plaintiff <br />petition be taken as true as against them qnd each of them. <br />And this cause coming on further for hearing was submitted to the court upon the pleadings <br />and the evidence, on consideration whereof, the court finds that the plaintiff on the 10th day of <br />,May, 1906 went into possession of Lot two (2) and Lot four (4) in Block eleven (11) of College Ad <br />dition to west Lawn, in Grand Island, Hall County, Nebraska. That said lots were vacant prairie <br />on said date, and that she at once commenced breaking out said lots, planting a garden, shrubs anc <br />,trees, and soon thereafter, erected a dwelling and other valuable improvements upon said premises, <br />y;and that she made said premises her home ever since said time, <br />Rind that she has been in open adverse, notorious, exclusive and undispu.tdd possession of said prep <br />ises since said aute, and is at this time. <br />The court further finds that one Justus Miller, claims or pretends to claim an interest in <br />said premises, the exact nature and extent of which is unknown to this plaintiff, and that Mrs. <br />Justus miller, whose real name is unknown is the wife of the said Justus Miller, and is therefore <br />made a party to this action. <br />It is, therefore, ordered, adjudged and decreed by the Court, that the title to'said hots <br />-two (2) and four (4) in Block eleven (11) in College Addition to west Lawn in the City of Grand <br />;Island, Hall County, Nebraska, be and the same is hereby quieted in the plaintiff Francis E. Grove <br />and the said Justus Miller and Mrs. Justus Miller, whose real name is unknown, and wife of the sai <br />Justus Miller, or any persons claiming by, thru, or under tnem, be and are forever barred from <br />claiming or setting up any right, title or interest whatsoever in said premises, adverse to the <br />rights of this plaintiff. <br />It is further considered by the court that the plaintiff pay the costs of this action taxed <br />in the sum of $22.50 <br />James R.
