James R. Hanna, one of the Judges ot' the Baia District, the following among other <br />proceedings were had in the words and figures following, to -wit- <br />Minnie J. Gorman, <br />.Elmer Ellsworth Gorman, George Gordon <br />Gorman and John Barrett as guardian for <br />said Edith Isabella Gorman, Inez Cir- <br />cassice Gorman, Guy William Gorman, <br />Byron Floyd Gorman, Frank Arthur Gor- <br />man, Roy Barrett Gormar:, Elmer Ells- <br />worth Gorman and George Gordon Gorman, <br />minors, <br />Defendants <br />D E C R F E . <br />Now, on this Stn day of September, 1916, this cause carne on for hearing upon the petition of <br />plaintiff, and it appearing from the proof on file herein that said defendants, Paul Roland Gor- <br />man, Myrtle Eunice Belknap, Oscar Belknap aria Edith Isabella Gorman, had each entered their vol- <br />untary appearance in this cause, and that aue and legal service of summons, as by law required, <br />had been had aria made upon all of the remainder of said defendants, aria that the said defendants, <br />John Barrett, guardian, John .Parrett, Minnie Barrett, Paul Ronald Gorman, Myrtle Eunice Belknap, <br />Oscar Belknap ana Edith Isabella Gorman, had failed to plead or answer herein within the time as <br />by law required, they vdere each in open court thrice solemnly called and came not, and judgment b; <br />default was thereupon entered against each of their. <br />The said cause coming on further to be heard, upon the petition of said plaintiff, and the <br />answer of Chas. G. Ryan, guardian ad litem for said minor defendants, Inez Circassice Gorman, Guy <br />William Gorman, Pyron Floyd Gorman, Frank Arthur Gorman, Roy Barrett. Gorman, Elmer Ellsworth Gor- <br />man, and George Gordon Gorman, and upon the evidence of plaintiff and said defendants and on the <br />argument of counsel, and said cause being duly submitted to the court, and the court being duly <br />advised in the premises, finds for the plaintiff, and that the facts stated in her said petition <br />are true, that she is entitled to a decree as prayed. <br />The court further finds tnat Daniel B. Gorman died intestate while a resident of Platte C <br />ty, Nebraska, on August 26, 1914. leaving surviving; him as his only heirs at law, his widow, the <br />plaintiff herein, and his children, as named and set forth in said plaintiff's petition; that at <br />the time of hiu death he was seized as the owner in fee simple of the Northeast quarter of Sectir <br />Number Ten (10), in Township Number Eleven (11), North of Range Eleven (11), West of the 6th P.M. <br />in Hall county, Nebraska, together with other lands iccated in Platte county, Nebraska; that saic <br />defendant, John Barrett, was, by the county court of Platte county, Nebraska, duly appointed ad- <br />ministrator of the estate of said deceased, and that an action for the partition of the above - <br />described lands situate in Hall county, Nebraska, together with the lands situate in Platte coun- <br />ty,Nebraska, belonging to said deceased, was brought in tree district court of Platte county,Neb- <br />raska, and that, as alleged in said petition, the said above- described premises in Hall county, <br />Nebraska, were, by said court duly ordered sold by the referee appointed to make partition there <br />of; t:iat in pursuance with said order of sale, the said above described real estate in Hall county, <br />Nebraska, was duly advertised as by law required, and sold in the city of Grand Island, Hall <br />county, Nebraska, on October 6, 1915. <br />The court further finds that raid defendant John Barrett attended said sale, anu that he <br />
