<br />Edward H. Hostler, Thomas rho §tler ana William Hostler, sons; Margaret Hostler, Agnes Hostler and
<br />Irene Hostler, all minors under the age of 14 years, and being; daughters of John Hostler, a de-
<br />ceased son of the said Thomas Hostler, deceased; that the said John Hostler, deceased, departed
<br />this life before the death of the said Thomas Hostler deceased; that the defendant, Goldie Host-
<br />ler is the wife of the defendant, Thomas Hostler; tnat the defendant Ruth Hostler is the wife of
<br />the defendant William Hostler; and that the defendant Bertha Hostler is the wife of the defen-
<br />dant Edward H. Hostler; that the said Thomas Hostler, deceased, never made or executed a deed to.
<br />said premises in favor of plaintiff, nor were the executors of the last will and testament of the
<br />said Thomas Hostler, deceased, given power and authority by the terms of said will to convey real
<br />estate; that plaintiff is entitled to a deed conveying said real estate to him by fee simple
<br />title upon payment to the executors of the estate of Thomas Hostler, deceased, of the balance due
<br />upon the purchase price of said premises.
<br />It is, therefore, ordered, adjudged and decreed by the court that the plaintiff be and he
<br />hereby is awarded a specific performance of the terms of said written contact of sale and purchas(
<br />of the premises hereinbefore described, and the defendants, Edward H. Hostler and R. R. Horth, as
<br />executors of the last will and testament of the said Thomas Hostler, deceased, are hereby author-
<br />ized, directed and commanded to execute and deliver to the plaintiff, a deed conveying to plain-
<br />tiff said Lot One (1) in Block Thirty seven (37) of Charles Warmer's Addition to the City of Gran(
<br />Island, in Hall county, Nebraska, by fee simple title, upon payment to them of the sum of $110.00
<br />with interest thereon at the rate of 6 per cent per annum from the 9th day of July, 1916, being
<br />the balance due upon the purchase price of said premises, and the plaintiff is hereby directed
<br />and commanded to pay to the defendants, Edward H. Hostler and R. R. Horth, as executors of the
<br />last will and testament of the said Thomas Hostler, deceased, said sum of $110.00 with interest
<br />as aforesaid, within twenty days from the entry of this decree, and that upon his failure so to
<br />do that said premises be sold as upon execution, and that an order of sale be issued therefor by
<br />the Clerk of this Court to satisfy the amount so found due to the said Edward H. Hostler and R. R.
<br />Horth, as executors as aforesaid, with interest and the costs attending such sale.
<br />It is further ordered by the court that a fee of $1,5.00 be allowed to J. L. Cleary as guard-
<br />ian ad litem for the minor defendants, to be taxed as a part of the costs of this case, and that
<br />the defendants Edward ii. Hostler ana R. R. Hortn, as executors of the last will and testament of
<br />.the said Thomas Hostler, deceased, pay the costs of this action, taxed at $36.65.
