<br />and that the time fixed by the court for the presentation, adjustment and allowance of claims
<br />against said estate has expired, it is therefore ordered that all claims against said estate, not
<br />now on file in said court, excepting only such as are not required by law to be presented for al-
<br />lowance, be and the same are hereby forever barred.

<br />Now, on this 12th day of June 1916, this cause came on for
<br />hearing upon the petition of Anna M. Rubendall, administratrix, for distribution of the residue
<br />of said estate now in her possession, due notice thereof having been given, and all parties inter-
<br />ested having waived notice, and the evidence, and was submitted to the court. On consideration
<br />whereof, the court finds that all debts, claims, and demands against said estate have beenpaid,
<br />and that there remains a residue in the hands of the administratrix in the sum of $319.29; that
<br />Anna M. Rubendall is the widow of said Peter Rubendall, deceased, and Ward M. Rubendall is a son
<br />and Clarence Rubendall is a son of said Peter Rubenaall, deceased, and the only persons entitled
<br />to share in said residue, and that the sum of 4750.00 has been paid to Anna M. Rubendall as an
<br />advancement, and equal sums have been paid to both Ward M. Rubendall and Clarence Rubendall as
<br />advancements; that after deducting said sums advanced, there remains for distribution the sum of
<br />0319-29; that Ward M. Pubendall a son is antitled to $70.27; Clarence Rubendall, as son is entit-
<br />led to #70.27; that Anna M. Rubendall, widow is entitled to $178.76.
<br />It further appearing that said Peter Rubendall died seised of the following Bills, notes,
<br />bonds, stocks and chattels which are in the hands of the administratrix for distribution, to -wit:
<br />Two promissory notes given by James T. Rabb anu Ada D. Nabb, his wife, to Anna M. Rubendall,
<br />( Guardian of Peter Rubendall,'both dated April 13, 1915 aria drawing eight per cent interest, one
<br />of said notes being in the sum of $400.00 and becoming due and payable December 5, 1915, and one
<br />of said notes being in the sum of $800.00 and becoming due and payable the 5th day of December
<br />1917, both of which said notes are secured by a mortgage on the following described land, td)-Wit'. I

<br />N.W.4 of section 2, township 25 N. Range 49 W. 6th P.M., said mortgage being dated April 13,1915
<br />and which said mortgage was filed for record in the office of the County Clerk of Box Butte Count 3,
<br />Nebraska on the 24th day of April 1915 and there recorded in Book 28 of Mortgages at Page 361;
<br />that on the 24th day of August 1915 aaid Anna M. Rubendall as Guardian of Peter Rubendall assigned
<br />said mortgage and notes to Anna IT. Rubendall, administratrix of the Estate of Peter Rubendall,
<br />jwhich said assignment was filed for record in the office of the County Clerk of said County of Bo
<br />Butte on the 24th day of August 1915 and there recorded in book 30 of mortgages at page 31; said
<br />Peter Rubendall also died seized of thirty -five shares of stock in the First National Bank of
<br />Madison, Nebraska, and ten shares of stock in the Home Savings Bank of Madison, Nebraska; six hun-
<br />!dred shares of stock in the Big Five Mining Company of Denver Colorado, and two ponds in the sum
<br />of $600.00 in the said Big Five Mining Company; that said Anna M. Rubendall, Ward V. Rubendall
<br />and Clarence Rubendall are each entitled to one -third of said stocks, bonds notes, mortgages and
<br />Ichattels above described.
<br />IT IS THEREFORE ORDERED AND DECREED th�it said residue be divided as follows: To Anna M. R
<br />loll, tree sum of $178.76, ana two hundred shares of stock in the Big Five ,mining Company of
<br />Colorado; to Ward Y. Rubenaall, the sum of $27.27, and two hundred shares of stock in the Big Fiv
<br />jMining Company of Denver Colorado; and to Clarence Rubendall the sum of $27.27 and 200 shares of
<br />;stock in the Big Five Mining Company of Denver Colorado; that the Bank stock in the First Nati
<br />;Bank of Madison, Nebraska ana the Home Savings Bank of Madison, Nebraska, the two bonds in said
<br />'Big Five Nining Company and the two notes against James T. Nabb and Ada D. Babb and the said
