Balmat, a son of the deceased, and one of her heirs at law, <br />praying for a settlement of the estate of said deceased, a determination of her heirs to the ri <br />of descent of her real property; and it appearing, from the proof on file herein, that due and <br />legal notice, by publication for three consecutive weeks, as by law and orders of this court re- <br />quire, had been given to all creditors, heirs ana persons interested-in the said estate, of the <br />filing of said petition,and of the time and place for hearing thereon, as fixed by this court, <br />which time was more than thirty days and less than sixty days, after the filing of said petitions <br />that there being no objectionsmade thereto, the said cause was duly submitted to the oourt upon <br />said petition, and the evidence of the petitioner in support thereof. <br />And said cause, being duly submitted to the court, and the court advised in the premises, <br />final that the allegations of said petition are true; that said Catherine E. Balmat died intes- <br />tate in Hall County, Nebraska, on February 29, 1912; that she was at the time of her death a res- <br />ident of said Hall County, Nebraska; that she died seized of an estate of inheritance located in <br />Hall County, Nebraska, as hereinafter stated; that more than two years have elapsed since her <br />said death; and that no application has been made in the state of Nebraska for the appointment of <br />an administrator of her estate, and that no administration thereof has been had in the state of <br />Nebraska. <br />The court further finds that said deceased left surviving her as her only heirs at law, the <br />following named persons: Joseph V.Balmat, her widower, of Alda, Nebraska;. Stella M. Campbell, a <br />daughter, of Central City, Nebraska; Evelyn Blanche Steele, a daughter, of Alda, Nebraska, Mabel <br />Denman, a daughter, of Alda, Nebraska; Pearl J. Balmat, a daughter of Alaa, Nebraska, and Henry <br />B. Balmat, a son, of Alda, Nebraska; and that all of said heirs are more than twenty -five years <br />of age. <br />The court further finds that said Catherine E. Balmat, deceased, was the mother of all of <br />said children, and the said Joseph V. Balmat, their father; <br />The court further finds that said deceased died seized In fee simple title (being an estate <br />of inheritance) of the following described real estate situate in Hall County, Nebraska, to -wit: <br />Lots Numbered Two (2), Three (3).and Four (4) in Mock Twenty (20) of a Town named Alda, in <br />Hall County, Nebraska, according; to the recorded plat thereof on file in the office of the County <br />
