The Court finds that the said Florence E.Miller Is the second wife of the deceased and is not the mother of his children and that the said Florence E.Miller, his widow, has filed in this court her declination to take under the will and her election to take under the law of descent of the State of Nebraska, and that therefore the above mentioned and described real estate did pass and- descend at the death of the said Howard C.Miller in the manner following: To Florence E.Miller, his widow, one fourth part thereof in fee To Guy T.Miller, Ralph I.Miller and Carl Miller, his sons, three fourths part thereof in fee, subject to the homeste.ed rights of the widow, therein. It is therefore considered and adjudged by the court that Lot Number 7 in Block Number 117, in Railroad Addition to the City of Grand Island, in Hall County, Nebraska and a i interest in Lots in Block Sixteen (16) One (1) and Two (2),Ain Baker's Addition to Grand Island, Nebraska, did pass and,descend at the death of Howard C.Miller, under the provisions of the; law of descent of the State of Nebraska, t the above named heirs of the deceased in the manner following: i j F To Florence E.Miller, his widow, one fourth part thereof in fee; to Guy T.Miller, Ralph I.Miller, and Carl Miller, his sons three fourths part thereof in absolute title, subject to the homestead rights of the said Florence E.Miller in and to said real estate.
