UP OMME REDURM fiJ o 0. <br />42654 -KLOPP A BARTLETT CO., PRINTING, LITH OG RAPHI NG.STATIO NERY: OM-KhA <br />quests under the provisions of the will and have accounted for all of the estate which came into <br />their possession and that there remains no property in their hands for distribution. <br />The court finds that notice was given to all creditors of the said Cay Henrik EWold.t, de- <br />ceased., of the time allowed and place appointed for filing claims against the estate of said de- <br />ceased, by publication of such notice as required by law and the order of Court; that the time <br />limited for filing, claims has fully expired; that no claims of any nature were filed against said <br />estate; that all claims outstanding against said Cay Henrik Ewoldt, deceased, not so filed, if <br />any such there be, are therefore forever barred and excluded. <br />It is therefore considered and adjudged by the court that all persons are forever barred <br />from filing or setting up any claims or demands against the estate of Gay Henrik Ewoldt, deceas- <br />ed, and that said estate is fully settled and closed. <br />It is ordered, adjudged and decreed that the report of tale executors of the last will and <br />testament of Cay Henrik Ewoldt, deceased, be and the same hereby is approved and allowed as and <br />for their final account and they are discharged o-f their trust and their bond released. <br />The Court finds <br />that <br />the <br />said Cay Henrik Ewoldt <br />departed <br />this life on the <br />first <br />day <br />of Nov - <br />ember,1914, being at <br />the <br />time <br />of his death a, resident <br />of Hall <br />County, Nebraska, <br />and <br />the <br />owner of <br />real estate therein, and that tie left a last will and testament which instrument was duly proved, <br />allowed and admitted to probate in this court on the 23rd day of December, 1914, and entered of <br />record in this office. <br />The court finds that the said Cay Herrik Ewoldt died seized in fee of the following describ- <br />ed real estate situate in the County of Hall and State of Nebraska, part of wnich real estate was <br />held under the nerve of Cay H.Ewoldt and part under the name of C.H.Ewoldt, to -wit: <br />The North east Quarter., the east half of the North West Quarter, the South west Quarter and <br />a triangular tract of land in the North west corner of the South east Quarter more particularly <br />described as follows: Coramencing at a point 80 rods directly west of the quarter post on the east <br />side of section 36, in Township 11,.North, of Range 10, West, Thence running g0 rods directly <br />west to the North west corner of trie South east Quarter of said section 36. Thence directly south <br />along the west line of said South east Quarter 17 chains and 17 links. Thence in a bow line back <br />to the place of beginning, said bow line being 2 chains and 3 links, in the center, south east <br />from a straight line between the points mentioned, said triangular tract containing 20 acres, <br />and all of the above described land being in Section 36, in Township 11 North, in Range 10 West <br />of tie 6th P.M. <br />All of Lot Two (2), on mainland and Tsland, in Section One (1), in Township 10, north, in <br />r <br />Range 10 west, as described on plat recorded in the office of the Register of Deeds of Hall Coun- <br />ty, Nebraska. <br />The court finds that under and by virtue of the terms and provisions of said last will and <br />testament t"ie east half of the north east quarter (E.j.of the N.E.J) and a tract of land commenc- <br />ing at. the north east corner of the west half of said north east quarter, running thence west 50 <br />rods, thence south 80 rods, thence east 50 rods, thence north 80 rods to the place of beginning, <br />and containing 25 acres, all in Section Thirty -six (36) , in Township Eleven (11) North, in Stange <br />10 west, and <br />the west half of the east half of Lot Two.(2), on mainland and island, in Section One (1), <br />in Township Ten (10), ire Range Ten (10), west, did pass and descend at the death of the said Gay <br />Henrik Ewoldt to BERNHARD BWOLDT in fee, the boundaries of this devise being indicated on rough <br />plat attached <br />to the <br />will <br />and marked Exhibit <br />"A ". <br />The court <br />finds <br />that <br />under the.provisions <br />of said last will and testament the West half of <br />the South west Quarter (W.J of S.W. +) and a tract of land commencing at the north east corner of,, <br />said west nalf of Said South west Quarter, and running thence north along the east line of the <br />I <br />J <br />
