<br />I, Samantha C.A.Cumm.ings, of Grand Island, Nebraska, being of sound mind and disposing mem-
<br />ory, do make and publish this my last will and testament in the manner and form following, that
<br />is to say:
<br />FIRST
<br />I give an�levise unto my husband M. V. Cummings, Lot Number Six (6), in Block Number Fifty
<br />(50), of the original town, now city, of Grand Island, Hall County, Nebraska.
<br />SECOND.
<br />I give and devise unto my son, A.B.Cummings, trustee, in trust, the Southeast quarter of See-
<br />tion Number Twelve (12), in 'Township Number Eleven (11), North of Mange Number Eight (S), West in
<br />Hamilton County, Nebraska, upon the uses and trusts and for the purposes following: To have and
<br />to hold the same in trust until my youngest son, W.M.Cummings, arrives at trie age of thirty -five
<br />years and w;ien my said son, W.M.Curuiing s, shall have arrived at the age of thirty -five years then
<br />t-.e land hereby devised to my said son, A.B.Cummings, as trustee, to become the absolute property
<br />of my three sons, A.B.Cummings, B.L.Cummings and W.M.Cummings, share and share alike, prdvided
<br />however, that should either of my said sons encumber or attempt to encumber said premises or any
<br />part thereof or any interest therein before my said son W.M.Cummings, arrives at the age of thir-
<br />ty -five ,years, than and in such an event, the son or sons encumbering; or attempting to encumber
<br />said premises or any part thereof or any interest therein within the period above limited, shall
<br />take no interest in said premises when my said son, W.M.Cumming_;s, arrives at the age of thirty -five
<br />.years, nor s_Zall any jujgement rendere(i against either of my sons, prior to said time, create any
<br />lien upon the said premises, but the same shall pass absolutely to the sore or sons who have not
<br />encumbered or attempted to encumber said premises or any part Hereof or any interest therein,
