<br />Now on this 28th day of October, 19142 this cause came on for hearing upon the
<br />,final report of Emma S.Mieth, Administratrix of the estate of August L.Mieth, deceased, it appear+
<br />ing that notice was published as required by law and the order of court, dated October 15, 1914,
<br />and there being no objection or protest on file.
<br />i
<br />,Upon examination of said report the court finds that the same is correct in all respects and ought
<br />!to be approved and allowed; that the administratiix has accounted for all of said estate which
<br />came to her possession or under her control, and that after the payment of debts, widow's allow- j

<br />ance and expenses of administration, she has distributed the remainder of the personal property
<br />among the legal heirs of the said August L.Mieth, deceased. _
<br />'The Court finds that due notice was given to all creditors of the time limited and place appoint-
<br />ed for filing claims against said estate; that the time allowed for filing claims against said
<br />estate has fully expired; that all claims filed and allowed against said estate have been paid
<br />and satisfied; that all claims outstanding against the said August L.Mieth, not so filed, if any
<br />such there be, are therefore forever barred and excluded.
<br />It is, therefore. considered and adjudged by the court that the report of Emma S.Mieth, adminis-
<br />tratrix, be and the same hereby is approved and allowed as and for her final account-. I
<br />I
<br />It is further considered by the court that all persons are forever barred from filing or setting
<br />up any claims or demands against the estate of August L.Mieth, deceased, and that said estate I
<br />{
<br />is fully settled and closed.
<br />The court finds that the said August L.Mieth departed this life on the 10th day of February, 1914,
<br />a resident of Hall County, Nebraska, and that he died intestate; that he left surviving him as his
<br />heirs at law, and his only heirs at law, the following named persons: i
<br />Emma S.Mieth, his widow.,; Fred W.Mieth, his son; Frank A.Mieth, a son; Mary I.Mieth, a daughter;
<br />Nathalie A.Mieth, a daughter; Otto H.Mieth, a son, and Everett S.Mieth, a son.
<br />The Court finds that the said August L.Mieth was at the time of his death the owner of the fol-
<br />lowing described real estate, situate in the County of Hall and State of Nebraska, to -wit:
<br />The South -half of the North -west Quarter and the North -half of the South -west Quarter of t
<br />Section Four (4) in Township Eleven (11), North of Range Twelve (12), west of the 6th P.M.
<br />The South -half of the North -east Quarter and the North -east Quarter of the Northeast Quarter
<br />and the South -east Quarter of Section Five (5) in Township 11, in Range 12, west of the 6th P.M. j
<br />One Lot in Mount Pleasant Cemetery of Cairo, Nebraska, described as follows: Lot 34, Block 1,
<br />old part in Mount Pleasant Cemetery, situated in the Northeast v of Section 26, Township 12,Range
<br />12, and that under the provisions of the law of des--ent of the State of Nebraska, all of said
<br />real estate did descend at the death of the said August L.Mieth, intestate, in the manner follow-
<br />ing.
<br />To Emma S.Mieth, widow, one -third part thereof, in fee;
<br />To Fred W.Mieth, Frank A.Mieth, Mary I.Mieth, Nathalie A.Mieth, Otto H.Mieth and Everett S- -
<br />Mieth, his children, two - thirds part thereof in equal shares, subject to the homestead right
<br />of the said Emma S.Mieth in said real estate.
<br />!It is', therefore, considered by the court that the South -half of the N.W. and the North -half of
<br />the S.W.4 of Section 4, Township 11, North, Range 12, west of the 6th P.M. and
<br />The South J of the N.E. and the N.E.�I of the N.E. and the S.E. of Section 5, in Township 11,
<br />;Range 12, and One Lot in Mount Pleasant Cemetery, Cairo, Nebraska, to -wit:
