<br />of said deceased, trie homestead of the said Cornelia T.Phillips and of her paid husband, Frederick
<br />Phillips; and t%iat as such homestead the same passed acid descended upon the death of said deceased
<br />to her surviving husband, tine said Frederick Phillips, for life.
<br />The Court further finds that the said above described real estate passed and descended, upon
<br />the death of said Cornelia T.Phiilips, under the law of descent in the State of Nebraska, in equal
<br />shares to her above namedrieirs -at -law, one -third part to each as tenants in common, subject to
<br />the life estate of the said Frederick ihillipS, under his homestead rights, in tyre said Northwest
<br />quarter of said Section Ten, as above found.
<br />The Court further finds that no administration has been had upon the estate of said deceased
<br />in the State of Nebraska, that more than two years have passed since her death, that she died in-
<br />testate, and no application has been made for the appointment of an administrator for her estate,
<br />and that all debts of said deceased and of her estate, if any exist, are forever barred and pre -
<br />clu'led, and that the cots of these proceedings have been paid.
<br />It is therefore by the court adjudged, considered and decreed that said deceased died intes-
<br />tate more than two ,years prior to the filing of said petition; that no application for the appoint-
<br />ment of an administrator of her estate has been made, nor has there been any administration upon
<br />her estate in the State of Nebraska; that she died seized in fee simple of an estate of inheritance,
<br />situate in Hall County, Nebraska, as above set forth; that she left survivtg her as her only heirs
<br />at law, the above named persons who bear the degree of kinship, to her as her surviving husband and
<br />children; teat the above described real estate passed and descended to said heirs -at -law in equal
<br />shares, one -third part to each, and to their heirs and assigns forever, and same is hereby so
<br />awarded to them, subject to the homestead rights, as provided by tie laws of Nebraska, of the said
<br />Frederick Phillips, surviving husband, in the said Northwest quarter of said Section Ten; that all
<br />debts of said deceased and her estate, if any exist, are forever barredd and precluded; aild that
<br />further administration of said estate is hereby dispensed with, and said estate forever closed..
