<br />Now on t,iis first day of February, 1916, this cause came on for
<br />hearing; upon the petition of mayme M.Burger, one of the children and an heir -at -law of said Cornel=-
<br />is T. Phillips, deceased,praying for settlement of the estate of said deceased, a determination of
<br />her heirs, and the right of descent of her real property, and it appearing, from the proof on file]
<br />i
<br />:herein., t'zat due and legal notice, by publication for three successive weeks, as by law and the
<br />orders of t`iis court require, had been given.to all creditors, heirs and persons interested in
<br />i
<br />,,said estate, of the filing of said petition, and of t_ie time and place for herein_, same, which I
<br />"time was more than tn.irty says, and leas than sixty days, after the filing of said petition, and
<br />here being no oojections made thereto, the said cause was duly submitted to the court upon said
<br />;;petition, and the evidence of tie petitioner in support thereof. And the court being; duly advised �

<br />in t:ie premises, finds tnat the allegations of said petition are true; that the said Cornelia T.
<br />Tftillips died intestate in Las Vegas, New Mexico, on June 21st, 1909, while a resident of Hall Coin-
<br />. i
<br />4ty, Nebraska,; that she died seized of an estate of Inheritance, located in Hall County, Nebraska,
<br />i
<br />!as hereinafter stated; that more than two years have elapsed since her death, and that no applica-
<br />I
<br />Lion °ias been made in the state of Nebraska for the appointment of an administrator of her estate, !
<br />I
<br />iiand that no administration has been had thereof.

<br />The Court further finds that said deceased left surviving her as her only heirs -at -law, the
<br />':following named. persons:

<br />Frederick Phillips, her husband, of Doniphan, Hall County,,Nebr.
<br />Elsie Leone Phillips, her daughter, Doniphan, Hall County,Nebr.
<br />mayme 1I.Aurger,(formerly Phillips) her daughter, of Grand Island,Hall County,Nebrask .
<br />(Wife of Edwin C.Pu.rger). i
<br />That all of the above named heirs are over 21 years of age, and that said Frederick Phillips,
<br />As t''ie father of both of said daughters..
<br />The Court further finds that said deceased died seized in fee simple (being an estate of In-
<br />heritance) of the following described real estate, situate in Hall County, Nebraska, to -wit: j
<br />The West Half (WL) of the Northeast Quarter (N.E.1), and the Northwest Quarter (N.W.J) of Sect
<br />ion Ten (10), in Township Nine (9), North, Range Ten (10) West or the 6th P.M.
