<br />To Lucy E.Kemptar one- t'iird part thereof in absolute titile;
<br />To Lucy Gertrude Burry, Carrie Maud Scilund, Charles "emptar, Frank J.Kemptar and
<br />Elmer E.Kemptar, t"ne remainin, two - thirds in equal shares as tenants in common, subject only to
<br />the homestoad rig.: -its of the said Lucy E.Kemptar in and to aaid real estate.
<br />It is therefore considered by the Court that the North a and the SEJ of Section 17 and the
<br />North 60 acres of the SWJ of Section 17 in Township 12, Range 12; the NEJ and the North of the
<br />SEJ of Section 20, Township 12, Range 12; the SVJJ and the South a of the NWJ of Section 21, Town -
<br />ship 12, in Range 12, as well as the abive described Cemetery Lot, all in Hail County, State of
<br />Nebraska, did pass and descend at the death o' the said Charles Kemptar, by virtue of the law of
<br />descent of the State of Nebraska, in the manner follol'ing:
<br />TO LUCY E. KE ?T'PTAR, one- t'iird part thereof to her and her heirs and assigns forever;
<br />TO LUCY GERTRUDE BURRY, CARRIE MAUD SCHLUND, CHARLES H. KEMPTAR, FRANK J. KEMPTAR and ELMER
<br />R. KP,'',TPTAR,the remaining two - thirds thereof in equal snares, to have and to hold to them and their
<br />heirs and assigns forever, subject only to the homestead right of the said Lucy E.Kemptar in said
<br />real estate.

<br />DECREE DETERMINING HEIRSHIP.

<br />Now on this 10th day of January, 1916, this cause came on for
<br />hearing upon the petition heretofore filed by Ephraim B.Engleman for a decree determining taie heir-
<br />ship and right of descent of property in the matter of the estate of Sallie T. Engleman, deceased,
<br />and it appearing to the satisfaction of the court from the proof now on file that notice of the
<br />filing of said petition and of the time and place fixed for the hearing thereon has been given to
<br />all persons interested in aaid estate, both creditors and heirs, by publication as required by law
<br />and tree order of court dated December 2, 1915-
<br />On consideration of the petition and the evidence submitted the court finds that the said
<br />Sallie T. Engleman departed this life on the 7th clay of October, 1913; that she died intestate;
<br />that more than two years have elapsed since the date of the death of the said deceased; that she
<br />died seized of an estate of inheritance in the State of Nebraska, and that no application has been
<br />made in this state for V'ie appointment of an administrator of the estate of said deceased.
<br />The court finds that the said Sallie T. Engleman was at the time of her death the owner in fee
