<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />In the matter of the estate of)
<br />FINAL DECREE
<br />HALA SITEATON DECEASED.)
<br />Now on this 23rd day of October, 1915, this cause came on for
<br />hear=ing upon the final report of Daniel Smeaton, administrator of the estate of Hala Smeaton, de-
<br />ceased, it appearing to the satisfaction of the court from the proof now on file, that notice of
<br />the filing of said report and of the time and place fixed for the final settlement of said estate
<br />has been published as required by law and the order of court dated October 12, 1915, and no one
<br />having appeared to object or protest against the allowance of said report.
<br />After a full examination thereof the court finds that the same is correct in all respects
<br />and ought to be approved and allowed as and for the finial account of said administrator; that said
<br />administrator has accounted for all of the estate which came to his possession or under his con-
<br />trol; that he has paid the costs of administration and that there remtLins nothing in his hands
<br />for distribution.
<br />The Court finds that due and legal notice was given to all creditors of the said Hala Smeaton,
<br />deceased, of the time limited and place appointed for filing claims against said estate; that the
<br />time allowed for filing claims has fully expired; that no claims were filed against said estate;
<br />that all claims outstanding against the said estate not filed within the time allowed, if any such
<br />there be,are therefor forever barred and excluded.
<br />It is therefore ordered that the report of Daniel Smeaton, administrator, be and the same
<br />hereby is allowed as and for his final account and he is discharged of his trust and his bond re-
<br />leased.
<br />It is further adjudged and considered that all persons are forever barred from filing or
<br />setting up any claims or demands against the estate of Hala Smeaton, deceased, and that said es-
<br />tate is fully settled and closed.
<br />The court funds that the said Hala Smeaton departed this life on the 8th day of February,1915,
<br />being at the time of her death a resident of Hall County, Nebraska, and that she died intestate;
<br />that she left surviving her as her heirs at law and her only heirs at law, the following nailed
<br />persons: Daniel Smeaton, her husband, and George Smeaton, Arthur Smeaton, Ruben Smeaton, Howard
<br />Smeaton, olive Smeaton, Ruth Smeaton and Theodore Smeaton, her children.
<br />The court finds that the said Hala Smeaton died possessed of the following described real es-
<br />tate situate in the County of Hall and State of Nebraska, to -wit:
<br />The North -half of the North west Quarter (N J of N.W.J) of Section Four (4),.in Township
<br />Nine (9), in Range Eleven (11), and The South -west Quarter of the North -west Quarter (S.W.J of
<br />N. W. 1 ) of Section Four ( 4 ) in Township Nine ( 9 ) in Range Eleven (11) ; that under the law of des-
<br />cent of the State of Nebraska, said real estate did pass and descend at her death in the manner
<br />following:
<br />To Daniel Smeaton, her husband, one -third part thereof in absolute title;
<br />To George Smeaton, Arthur Smeaton, Ruben Smeaton, Howard Smeaton, olive Smeaton, Ruth
<br />Smeaton and Theodore Smeaton, two - thirds part thereof in equal snares, subject to the homestead
<br />right of the said Daniel Smeaton in and to slid real estate.
<br />It is therefore considered and adjudged by the court that the North a of the North west J
<br />and the South west of the North west 4i all in Section 4, in Township 9, in Range 11, in Hall
<br />County, Nebraska, did descend at the death of Hala Smeaton, intestate, as follows : -
<br />To Daniel Smeaton, one third part thereof in fee:
<br />To George Smeaton, Arthur Smeaton, Ruben Smeaton, Howard Smeaton, Olive Smeaton, Ruth Smeaton
<br />and Theodore Smeaton, two - thirds part thereof in equal shares as tenants in common, being an un-
<br />divided 2/21 part to each, and all subject to the homestead rights of the said Daniel Smeaton
