<br />ceased, pass and descend, by operation of law, in equal shares to the said Rosa R. Winn, widow
<br />and the said Howard Atkins Winn, son, subject,however,to the homestead rights of the said Rosa R. III

<br />Winn, widow, for life, as provided by the laws of descent of the State of Nebraska, and that same
<br />consisted of one town lot in an Incorporated city of the State of Nebraska.

<br />It is;therefore,by the court, ordered, adjudged and decreed that said final report of said

<br />administratrix be and the same hereby is approved and confirmed; that the above described real es
<br />state passed and descended, at the death of the said deceased, by operation of law, in equal share,

<br />to the said Rosa R. Winn and Howard Atkins Winn, only heirs at law of the said Otis J. Winn, de-
<br />ceased, subject to the homestead rights of the said Rosa R. Winn. Widow, as provided by the laws
<br />of the State of Nebraska; that all persons having claims against said estate, if any such there
<br />be, are forever barred and precluded from asserting or setting up any claim against said estate;
<br />that said estate is hereby closed, said administratrix discharged and her bond released.

<br />Be it remembered that on the lltYh. day of June, 1915, that being one of the days of the June
<br />`Term 1915 of the District Court of the 11th Judicial District of the State of Nebraska, within
<br />`for the County of Hall, held at the Court House in the City of Grand Island, before Hon. James R.
<br />;Hanna, one of the Judges of the said District, the following among other proceedings were had in
<br />the words and figures following to -wit:-

<br />This day came the plaintiff in person and by M.T.Garlow, her attorney,
<br />:;and the defendent still failing to answer, demur, or otherwise plead to the petition of the plain -
<br />stiff, was thrice solemnly called in open Court, and came not, but made default, and it appearing
<br />to the Court that the said defendant had been duly notified of the filing; and pendency of this ac-
<br />tion by personal service of summons upon him in the manner provided by law, it is ordered that his
<br />default be entered herein and that the facts stated in the plaintiff's petition be taken as true
<br />as against him.
<br />And this cause coming on further for hearing was submitted to the Court upon the pleadings
<br />the evidence, on consideration whereof, the Court finds that the plaintiff at the time of fil-
<br />r_g her petition had been a resident of the State of Nebraska for more than five years immediately
