<br />the premises hereinbefore described for the sum of $13,400, in co nformity to the terms of said
<br />written contract.
<br />The Court Further finds t hatW /estate of the said Fred Shultz, deceased, is now in the pro-
<br />;cess of administration in the County Court of Hall County, Nebraska, and is unsettled and that pay-
<br />ments under said written contract should be made to Sophia K. Shultz, as administratrix of the es-
<br />tate of the said Fred Shultz, deceased, and that the note and mortgage to be executed by plaintiff
<br />under the terms of said written contract should run to the said Sophia K. Shultz, as administratrix
<br />of the estate of the said Fred Shultz, deceased.
<br />The Court further finds that under the terms of said written contract the said Sophia K.
<br />Shultz, as administratrix of the -estate of Fred Shultz, deceased, should furnish to the plaintiff
<br />an abstract of title to said premises showing marketable title in the said Fred Shultz, now de-
<br />ceased, and showing said premises to be free and clear form taxe -91, liens and incumbrances.
<br />WHEREFORE, it is ordered, adjudged and decreed by the Court that the plaintiff be and he
<br />hereby is awarded a specific performance of said written contract for the sale of the premises
<br />hereinbefore described.
<br />It is further ordered, adjudged and decreed by the Court that the said Sophia K. Shultz, as
<br />administratrix of the estate of the said Fred Shultz, deceased, and in her individual capacity as
<br />surviving widow of the said Fred Shultz, deceased, make, execute and deliver to the plaintiff a
<br />deed conveying to the plaintiff the fee simple title to the Southeast quarter of Section Twenty
<br />Two (22), in Township Eleven (11) North, Range Twelve (12) West of the 6th principal Meridian, ex-
<br />cepting a five acre tract therefrom, which said five acre tract was sold, conveyed. a % transferred
<br />to the Cameron Cemetery Association by three several deeds recorded as follows: One in Book 2,
<br />at page 226, one in Book 22, at Page 190, and Ine in Book 34, at Page 401, all of the Deed Records
<br />of Ball County, Nebraska, respectively, situated in Hall County, Nebraska, upon the payment by
<br />plaintiff to the said Sophia K. Shultz, as administratrix of the estate of the said Fred Shultz,
<br />deceased, of the sum of 41,035 in cash and the execution and delivery to her as such administratrix
<br />of the promissory note of the plaintiff for the sum of 413,400, bearing interest at the rate of six
<br />per centum per annum from March 1st, 1915, interest payable annually, and the principal of said
<br />note due five years from March 1st, 1915, but containing an option to plaintiff to pay #1,000 or
<br />any multiple thereof of the principle at any time, and the execution and delivery to the said
<br />Sophia K. Shultz, as such administratrix, of a first mortgage upon the premises hereinbefore des-
<br />cribed, signed and executed by the plaintiff and his wife, as security for the payment of said
<br />promissory note and interest, and that thereupon said defendants and each of them and all persons,
<br />claiming by, through or under them or either of them, be forever barred, enjoined and excluded
<br />from setting up or asserting any right, title, interest or clai "m in and to said premises adverse
<br />to plaintiff, excepting the rights by virtue of the mortgage to be given by the plaintiff, as
<br />hereinbefore provided.
<br />It is further ordered, adjudged and decreed by the Court that A. C. Mayer be and .he hereby is
<br />allowed the sum of 10 for his services as guardian ad litem for the minor defendant, Florence P.
<br />Shultz, the same to be taxed as part of the costs of this suit.
<br />It is further ordered, adjudged and decreed by the Cmzrt that the costs of this action,
<br />taxed at be paid by the defendant, Sophia K. Shultz, as administratrix of the estate
<br />of Fred Shultz, deceased.
