<br />Be it remembered, That on this 9th day of March, 1915, that being one of the days of the
<br />February Term 1915 of the District Court of the 11th Judicial District of the State of Nebraska,
<br />within and for the County of Hall, held at the Court House in the City of Grand Island, Nebraska,
<br />before Hon. James R. Hanna, one of the Judges'of the said District, the following among other pro-
<br />ceedings were had in the words and figures following to -wit:-

<br />Now on this 9th day of March, 1915, this cause came on to be heard and the court finds that
<br />the defendants, Sophia K. Shultz, Ella B. Veeder, Orville Veeder, Ervin C. Shultz, Nellie K.
<br />Crafford, Gertrude M. Shultz and Sophia K. Shultz, as administratrix of the estate of Fred Shultz
<br />deceased, have each entered his and her voluntary appearance herein, waived the issuance and ser-
<br />vice of summons and time to answer and have requested that the prayer of plaintiff's petition be
<br />granted, and the court further finds that the defendant, Florence P. Shultz, is a minor over 16
<br />years of age and has been .riu.1y served with summons herein.
<br />And this cause coming on farther to be heard upon the petition of the plaintiff, the request
<br />of the defendants, Sophia K. Shultz, Ella B. Veeder, Orville Veeder, Ervin C. Shultz, Nellie K.
<br />Cr. afford, Gertrude M. Shultz and Sophia K. Shultz, as admini stratrix of the estate of Fred Shultz,
<br />deceased, that the prayer of plaintiff's petition be granted, and the answer of A. C. Mayer, as
<br />guardian ad litem for Florence P. Shultz, minor defendant, and the evidence, and the court being
<br />fully advised in the premises finds that the facts stated in plaintiff's petition are true; that
<br />on the 11th day of June, 1914, and for a long time prior thereto, one Fred Shultz, now deceased,
<br />was the owner in fee simple of the following described real estate situated in the County of Hall
<br />and State of Nebraska, towit:
<br />The 'Southeast quarter of Section Twenty Two (22), in Township Eleven (11) North, Range Twelve
<br />(12) West of the 6th Principal Meridian, excepting a five acre tract therefrom, which said five
<br />acre tract was sold, conveyed and transferred to the Cameron Cemetery Association by three several
<br />deedsrecorded as follows: One in Book 2, at Page 226, one in Book 22, at Page 190 and.one in Bdok
<br />34 at Page 401, all of the Deed Records of Hall County, Nebraska, respectively; that on or about
<br />said 11th day of June, 1914, and under said date, the said Fred Shultz, now deceased, and his wife,
<br />the defendant, Sophia K.Shultz, as Sophia Shultz, entered into a written contract with the plain-
<br />tiff, for the sale of said premises to the plaintiff for the sum of 416,000 and that at the time
<br />of the execution and delivery of said contract plaintiff paid to defendant, Fred Shultz, on the
<br />purchase price of said premises the sum of 41,500, and which said written contract is in words
<br />and figures following:

<br />This agreement made and entered into this lltn day of June A.D. 1914, by and between Fred
<br />Shultz and Sophia Shultz of Grand Island Hall County Neb. of the First part, and John Ewing of
<br />Wood River Hall County Nebraska, of the Second part,
<br />Witnesseth, That the said First parties has this day sold unto the said second party, the
<br />following described premises situated in Hall County Nebraska To :Wit South East quarter Section
<br />Twenty Two (22) Township Eleven North Range Twelve (12) West 6th Principal Meridian, containing
