<br />Now o_(j this 24th clay of october,1914,this cause came on for hearing upon the final report of
<br />Jam,q,,, E. Dodge, administrator of the estate of David Schanck, deceased, it appearin,
<br />been given to all persons interested,by publication,as required by the order of
<br />October 14,1914,and there being no objection or protest on file.
<br />Upon examination of said report the court finds that the same is correct in all
<br />ought to be al.lowed;that said administrator has accounted for all of the estate
<br />his possession and there remains nothing in his hands belonging to said estate.
<br />The court finds that notice was given to creditors of the said David Schanck of
<br />that notice has
<br />the court dated
<br />respects and
<br />which came to
<br />the time limited
<br />and place appointed for filing claims against the estate of said deceased;that the time allowed
<br />for filing claims has fully expired;that no claims of any nature were filed against said estate;
<br />that all claims autstanding against said estate and not so presented and filed, if any such there
<br />be,are therefore barred and excluded.
<br />It is therefore ordered,adjudged and decreed that the report of James E•Dodge,executor,be and the
<br />same hereby Is approved and allowed as and for his final account.
<br />It is further ordered that all persons are forever barred from filing or setting up any claims
<br />or demands against the estate of David SchancLt,deceased,anfl that said estate is fully settled
<br />and closed.
<br />The Court finds that the said David Schanck departed this life on the 4th day of liovainber,1912,
<br />and ttiat he left a last will and testament which Instrument was duly proved and admitted to pro-
<br />bate in this court on the 12th day of TIarch,1914,and. recorded in this office.
<br />The Court finds that the said David Schanck was at the time of his death the owner of the follow-
<br />Ing described real estate situate in the County of Hall and State of Nebraskato-wit:Tne West
<br />half of the North-west Quarter and ttie South-east Quarter of the North-we5t quarter of Section
<br />36,in Township 9,in Range ll,and that under the terms and provisions of his last will and test-
<br />ament,all of said above described real estate did pass and descend at his death,to his sister,
<br />Ida Dodge,to have and to hold to her and her heirs and assigns forever,upon the condition,how-
<br />ever,that the said Ida Dodge,her heirs, executors or assigns,shall pay to Mary E.Morris of Peoria,
<br />Illinois,to sum of two hundred dollars annually for her natural life,sucli annuity to be a charge
<br />upon t-in-e real estate here devised.
<br />The court finds that the said David Schanck was the owner,at the time of his death,of the follow-
<br />ing d,--scrlbed real estate situate in the County of Hall and State of Nebraska, to-wit:
<br />The North-east Quarter of the Borth-west Quarter and the North-half of the North-east quarter of
<br />Section 36,in township 9,in Range ll,west of the 6th P.M.,and that under the terms and provision,$
<br />of said last will and testament,all of said above described real estate did pass and desceild at
<br />the death of the tes"U*atorto his sister,ijartha E.Willard,in absolute title,upon the condition,
<br />however,ttlat the said 1,1artha E.Willard,her heirs,executor8 or assigns,shall pay to wary E.Morris
<br />ttie sum of two hundred dollars annually during trie term of tier natural life, said annuity to be a
<br />charge upon said real estate so devised.
<br />It is thereforeconsideredadjude
<br />,ed and decreed that the West a and the South -east 4 of Section
<br />36,Township 9,Range ll,in Hall County,Nebraska,did descend at the death of David Schanckunder
<br />the rrovisions of his last will and testament,to Ida Dodge,subject to the condition named and ex-
<br />pressed in said last will and testament,and that the North -east quarter of the.North-west Quarter
<br />and the North-half of the North -east quarter of Section 36,in Township 9,Range ll,in Hall County.,
<br />Nebraska,did pass and descend at the death of the said David Schanck,by virtue of the provisions
<br />and expressed
<br />of his last will and testament,to his sister,Martha E.Willard,subject to the condition namedAin
