WTHOGRAPH I, VG.S- TIONERY; OM,AhC. <br />Final Decree, <br />In The County Court of Hall County, Nebraska. <br />In the matter of the estate of <br />DECREE. <br />Thomas P.Rundlett, deceased. <br />4 <br />Now on this 7th day of November, 1913, this cause came on to be heard upon the peti- <br />tion of Herbert E.Rundlett, heretofore filed, and it appearing to the Court that notice has been <br />I <br />i <br />given to all persons interested as required by law and the order of Court, dated October 9, <br />1913, and no one having ap,neared to object, and there being no objection or rrotest on file, <br />the Court proceeds to hear said petition. <br />Bernice 1M.Hendricks and Henry E.Clifford were sworn and examined and their testimony was <br />reduced to writing and filed with the papers in the case. <br />The testimony of Jacob Bissing, Probate Judge of Ellis County, Kansas was also filed. <br />i <br />Gn consideration of all the testimony the Court finds : - <br />That Thomas P.Rundlett departed this life on or about the 20th day of April, 1889. and that he j <br />vied intestate; <br />i <br />That he was an inhabitant of the State of Nebraska and a resident of Hall <br />County: <br />That he was at the time of his death the owner of the following described real estate j <br />situate in the County of Hall and State of Nebraska, to-wit: hot Number Five (5) in Block j <br />i <br />Cne Hundred and Forty -three (143) of the Union Pacific Railway Company's Second Addition to <br />Grand Island, Nebraska,,; that said lot contains a one story house thereon used and occupied by <br />the deceased and his family as a homestead during his life time, and used and occupied by his <br />widow, Harriett K.Rundlett, after his decease and until she departed this life on or about the <br />28th day of December, 1906. <br />That said real estate at the time of the death of the said Thomas <br />P.Rundlett was of the value of less than $2000.00 and was exempt from being applied to the <br />payment of the debts of the said Thomas P.Rundlett, de ^eased, by attachment, Exe ^ut ion or any <br />other mesne process, and was not liable for any of the debts of the said deceased; <br />That the said Thomas P.Rundlett, left surviving him as his heirs at law, and his only heirs <br />at law, the following named persons: <br />Harriett K.Rundlett, his widow, now deceased ; <br />Edward E.Rundlett, a son, now deceased ; <br />Herbert E.Rundlett,a son, 47 years of age and residing in Tama, Iowa; <br />Bernice M.Hendrieks, a daughter, now 41 years of age and residing in Grand Island, Nebraska. <br />That under the law of descent of the State of Nebraska said real estate did pass and descend <br />at the death of the said Thomas P.Rundlett to the said Edward E.Rundiett, Herbert E.Rundlett <br />and Bernice M.Hendricks, in fee and in equal shares, subject to the life estate of the said <br />Harriett K.Rundlett and that said life estate ceased and determined at her death on or about <br />the 28th day of December 1906: <br />That the said Edward E.Rundlett departed this life on or about <br />the 27th day of December, 1903, in Ellis County, Kansas, and prior to the death of his mother <br />and that he left surviving him as his heirs at law and his only heirs at law, the following <br />named persons : <br />Sadie E.Chapman, his daughter, who resides at Ellis, Kansas, and is 26 years of age; <br />Everett R.Rundiett, his son who resides at Cmaha, Nebraska, and is 23 years of age,and that he <br />left a widow; <br />Jennie Rundlett, then residing at Ellis, Kansas. <br />The Court finds that the said Edward E.Rundlett was not seized of said real estate at the <br />time of his death and that his widow, Jennie Rundlett, therefore has no dower right therein; <br />That the said Edward E.Rundlett died intestate and that his share in said real estate descen- <br />ded to his two children, Sadie E.Chapman and Everett R.Rundlett in equal shares; <br />That the estate of Edward E.Rundlett was administ"red upon in the Probate Court of Ellis County <br />Kansas, and full settlement had and all debts paid. <br />
