That on the 9" day of September A.D.1912, said instrument to which j <br />i <br />this is: attached was duly Proved, probated and allowed as the last will and testament of the <br />I <br />said William N.Milier deceased, and the same was ordered to be recorded in the I records of the <br />court aforesaid. j <br />In witness whereof I have hereunto set my hand and the seal of the said <br />j County Court this 9" day. of September A.D.1912. <br />i <br />(SEAL) J.H.Mullin <br />County Judge <br />In the County Court of Hall County, Nebraska. <br />In the matter of the estate of <br />:._ Final Decree <br />p "William N.Miller, deceased. <br />Now on this let day of May, 1913, this cause came on for hearing upon the final <br />- report of Harry F.Miller, executor of the last will and testament of William N.Miller, deceased, <br />and it appearing to the Court from the proofs on file that all persons interested in said estate <br />_--ave been duly notified of the tire and place for this hearing in the manner provided by law <br />and as provided by the order of the Court heretofore entered herein and the Court having duly <br />examined said report and being fully advised in the premises, finds that the said Harry F.Miller <br />as such executor, has duly accounted for all of the estate of said William N.Miller, deceased; <br />that said report iS correct and ought to be allowed and approved as and for the final report of <br />! the said Harry F.Miller as executor of the estate of the estate of the said William N.Miller, <br />de--eased. <br />The Court further finds that Maggie J.Miller, widow of said William Y.Miller, dec- j <br />eased,has duly filed in v;riting herein here election to accept the provisions of the last I <br />i <br />will and testament of the said William N.Miller, deceased, in her behalf, in lieu of her rights <br />in and to s" -id estate under and by virtue of the laws of the State of Nebraska; that the said I <br />i <br />i <br />Harry F.Miller has turned over to the said Maggie J.Miller all of the personal estate of the <br />i <br />said William N.Miller, deceased remaining in his hands as such executor after the rayment of <br />the debts against said estate and the costs of administration, includin� the sun of P618.61 <br />all of whieh,urder the terms of said will, becomes her absolute property, excepting the1, 100 <br />4_ <br />note signed by Harry F.Miller and as to this the said Maggie J.Miller is to receive the inter - <br />est thereon until the same is paid and uron the payment of said note the principal there - 1 <br />i <br />of is to be divided equally between the said Harry F.Miller and George A.Miller, as provided " <br />� i <br />by the terms of said gill, and that the said Maggie J.Miller holds said note in trust for the <br />purpose of the payment to herself of the interest due on said note until the same is raid and <br />- I <br />when paid. The principal thereof to be paid to the said George A.Miller and Harry F.Miller, <br />i <br />share and share alike. <br />The Court further finds that due and legal notice has been given to all <br />persons of the time and place fixed for the presentment of claims against said estate; that the <br />I <br />time so fixed has frilly expired and that all claims against said estate not presented and all- <br />owed by the Court are fully barred. <br />The Court-.further finds that the said William N.Miller <br />died seized as the: owner in fee simple of the following described real estate situated in the j <br />County of Hall and the State of Nebraska, to -wit: The North half of the Northeast quarter of <br />Section Number Thirty Three (33),in Township Number Eleven (11), North of Range Number Eleven <br />(11)0 hest of the Sixth Principal Meridian and that by the terms of the last will and testament <br />of the said William N.Miller, deceased, the said Maggie J.Miller is to receive the rents, issues <br />and profits from said real estate so long as she remains the widow of the said William N.Miller, <br />deceased and after the death or remarriage of the said Maggie J.Miller the title to said pre- <br />miser descends by absolute title to the said George A.Miller and Harry F.Miller, share and share <br />
