<br />I. Charles H.Horth, of the Counties of Hall and Buffalo in the State of Nebraska, mind-
<br />ful of
<br />the uncertainty of.this mortal life and being of sound mind and disposing memory, do
<br />make and publish this my last will and testament in the manner and form following. That is to
<br />say : -
<br />First.
<br />I direct that all my just debts and the expenses attending my burial be first paid.
<br />Second.
<br />I give and bequeath unto my beloved brother, Hadley S.Horth, provided he survives me,
<br />the sum of Two Hundred and Fifty Dollars ($250).
<br />Third.
<br />I give and bequeath unto my beloved sister Eva Horth provided she survives me, the sum
<br />of Two Hundred Fifty (^"250) Dollars.
<br />Fourth.
<br />I give, devise and bequeath unto my beloved son Fred C.Horth, the following described
<br />real estate situated in the County of Nall and State of Nebraska, to -wit:-
<br />The Southeast quarter of Section No.6 and the North half of the Northeast quarter of "ection
<br />No.7 all in township Number 10 North of Range No. 12, Nest ; to have and to hold the same
<br />for his natural life, and the remainder I devise and bequeath unto my dear little grandson,
<br />Charles M.Horth, to have and to hold the same for -ever. Provided however, that in the event
<br />of the death of my said grandson , Charles M.Horth, without issue living at the time of his
<br />death, and before the death of my said son Fred C.Horth, then and in that event the fee simple
<br />title to the above described premises is to vest in my said son ,Fred C.Horth.
<br />Fifth.
<br />I give and devise unto my beloved son Ralph R.Horth,the following described real estate
<br />situate in the County of Buffalo, and State of Nebraska, to -wit:
<br />The South half of Section No.ti2 in Township No.10, North of Range No.14, Test, to have
<br />and to hold the same forever.
<br />Sixth.

<br />I give and devise unto my said sons, Frec C.Horth and Ralph R.Horth, in tri.st, and to the
<br />survivor of them in trust, the following described real estate situated in the County of
<br />Buffalo, and State of Nebraska, to- ��it:-

<br />I'o. 12, north of Rarge No.13 Test ; to have and to hold the same unto the said Fred C.Horth
<br />es, upon the uses and trusts and for the purposes following, and Ralph R.Horth, as such trust
<br />to-wit:- To holey manage, control and colle ^t tte rents, issues and profits arising there -
<br />arom, until my grandson Ralph Brodrick, shall have reached the age of thirty years, when if
<br />my said grandson , Ralph Frodrick., has by his own industry' accumalated the sum of One Thousand
<br />Dollars over and above all debts he may owe at that time then and in that event r< pa-Lid'
<br />trustees or the survivor of them, are to convey said premises to my said grandson Ralph Erodrick
<br />in absolute title, If nay said grandson Ralph Brodrick has not so accumulated the sum of One
<br />Q Thousand Dollars, and survives the age of thirty years, then said trust is to continue until
<br />lie has accumulated the sum of Cne Thousand Dollars; provided, that should the said Ralph
