<br />1913, this cause came on for hearing upon the final report of
<br />Now on this 28th day of May,
<br />Gustav Sievers and Henry A.Sievers, executors of the last will and testament of Henry Sievers,
<br />deceased, and it satisfactorily appearing to the Court that all persons interested in the
<br />estate of said deceased are of full age and have entered their voluntary appearance herein and
<br />ask that said report be approved, and it further appearing to the Court, after a full examina-
<br />tion thereof, that said report is correct in all respects and ought to be allowed as the final
<br />account of said executors, it is, therefore,
<br />ORDERED, ADJUDGED AND DECREED that the report of
<br />Gustav Sievers and Henry A.Sievers, executors , be and the same hereby is approved and allowed
<br />as and for their final account and that they are discharged of their trust.
<br />It is found by the Court that proper notice was given to all persons interested, in the
<br />manner provided by law, of the time allowed by the Court in which to file claims against the
<br />estate of said Henry Sievers and of the place appointed There such claims may be filed; that
<br />the time limited for presenting claims has fully ex,sires. ; that all claims filed and allowed
<br />against said estate have been paid; that all claims outstanding against said estate and not
<br />filed as required, are forever barred and excluded.
<br />It is therefore considered by the Court
<br />that all persons are forever barred from filing or setting up any claims or demands against
<br />the estate of Henry Sievers, deceased, and that said estate is fully settled and closed.
<br />The Court finds that the said Henry Sievers departed this life on the 2nd day of July,
<br />1911, leaving a last will and testament which instrument was duly allowed and admitted to
<br />Probate in this Court on the 12th day of September, 1911, and entered of record,
<br />The Court finds that the said Henry Sievers was at the time of his death the owner of
<br />the following described real estate situate in the County of Hall and State of Nebraska, to -wit:
<br />Fractional Lot 8 in Fractional Flock 104, in Railroad Addition to Grand Island, Hall County,
<br />Nebraska, and Fractional Lot 8, in Fractional Block 104 in Koenig & Wiebe's Addition to Grand
<br />Island, Nebraska; Lot 37 in Row 7 in Shoemaker's first Addition to the Grand Island Cemet-
<br />eryl e North -west quarter of the North -west quarter of Section 29, Township 11, Range 9,
<br />as the same is laid down and described on the plat of said addition on file in the County
<br />Clerk's office of said Nall County.
<br />The Court finds that under the provisions of said last
<br />will and testament the said Cemetery Lot above described did descend at the death of the testa
<br />for to Gustav Sievers and Henry Sievers in absolute title.
<br />The Court finds that under the
<br />terms and provisions of his said last will and testament Fractional Lot 8, in Fractional Block,
<br />104 in railroad Addition to Grand Island, and Fractional Lot 8 in Fractional Block 104 in
<br />Koenig & Wiebe's Addition to Grand Island, in Hall County, Nebraska, did pass and descend at
<br />the death of the testator, Henry Sievers, to Gustav Sievers, Louise Rohling, Carrie Paustian,
<br />Henry A.Sievers and Katie Tichman, share and share alike, to have and to hold to them and their
<br />heirs and assigns forever.
<br />It is therefore considered and adjudged by the Court that Fraction-
<br />al Lot 8 in Fractional Block 104 in Railroad Addition to Frand Island and Fractional Lot 8 in
<br />Fractional Block 104 in Koenig & Wiebe's Addition to Grand Island in Hall County, Nebraska,
<br />did pass and descend at the death of Henry Sievers ( also known as Henry Sievers Sr.) under
<br />the provisions of his last will and testament, to Henry A.Sievers, Gustav Sievers, Louise
<br />Rohling, Carrie Paustian, ( known also as Caroline Paustian) and Katie Wichman, share and share
<br />alike as tenants in common, and that Lot 37 in Row 7 in Shoemaker's Addition to the Grand
<br />Island Cemetery, situate in the North Nest quarter of the North west quarter of section 29,
<br />Township 11
<br />Range 9, as described on the plat of said addition on file in ,the office of the
<br />County Clerk of Hall County, Nebraska , descended under the will to Gustav Sievers and Henry
<br />A.Sievers. The Court finds that the Administrators have accounted
