<br />Now on this 2nd day of 1,ovember, 1912 this cause came on to be heard upon the final
<br />report and petition of Hans Scheel, executor of said es1rate, for settlement thereof and it app-
<br />earing from the proofs on file in this Court that legal notice as by law and the orders of this
<br />court required have been given to all parties interested of the filing of said report and the
<br />time for hearing.thereon and there being no objections thereto,and the Court on examination
<br />rinds tat sariie is in all respects correct and should be allowed and approved; the Court fur-
<br />ther finds, from-the proofs on file herein, that legal notice as by law and--the orders of this
<br />court required has been given to all persons having claims against said estate of the time and
<br />place for filing same, that said time has expired and that all claims filed against said estate
<br />and the costs of administration thereof have been fully _I)aid and that alllp rsons having claims
<br />against said . estate, if any, are forever barred and Precluded f rom making claim thereon and
<br />all such unfiled claims and debts are barred and precluded.
<br />The Court further finds that said executor has accounted for all and singular of the moneys
<br />and properties coming into his hands and has paid out and distributed same as by the orders
<br />of this court and the ,:vill of said deceased provided and directed and has made distribution of
<br />the remainder of said moneys and properties to the persons entitled thereto as shown by said
<br />report and receipts on file in tlis case; that there is still due and uncollected the sum of
<br />-:,150 rentals on the !and Lalonging to said estate for the season of 1912 from Henry Paustiar_,
<br />the sar:e being dyable January is t, 1913,; That said amount belongs in equal snares to the de-
<br />.
<br />visees of said deceased as ".ereinaf te-r stated.
<br />The Court further finds that said 3:"argaretha Thavenet died seized of the following descr-
<br />ibed real estate situated in '-Tall County, rJeoraska, toait : The Southeast quarter of the South
<br />West quarter of Section T:venty Two (22) and the "?otthwest quarter of the Northwest quarter of
<br />section T.renty Seven (2.7 ), and Lots One (1) and Taro (` ), on ilainland, and the North Ten acres
<br />of Lot Four (4), on Island, in section Twenty Seven (^7), all in Township Eleven (11), ! ?orth
<br />of Ran`;e Nine (9), Nest of the oth P.M. ( said ten acres Leing bounded on the South by a strai-
<br />ght East and West line running across said Lot 4) . Saving and excerpting from the above
<br />described land three t- acts as follo,vs: Cne conveyed to William H.C.Lambader, den., 1,,y ,warr-
<br />anty deed -recorded in Fook 5, Page 548, containing about tree acres and being a -art of said
<br />Lots 1 and 4; one conveyed to John C.C.Hann by :warranty deed recorded in Book 34, Page 389,
<br />containing about 2 acres and being a part of said Lot 1; and a third tract of about 10.9 acres
<br />conveyed by :largaretha Thavenet to Nilliam Thavonet by warranty deed recorded in Book 40-J Page
<br />1971 1.11 of the records of Hall County, Nebraska, and subject to the -right of ,way of a road
<br />leading to the "Thavenet Ice Pond" as described in-said last mentioned deed.
<br />Also, Lot Teo (u), in Block Three (3) in Vine Hill Addition to hand Island, Nebraska.
