<br />That the said Robert Y.Boggs left surviving
<br />now John C.Cowin and Francis A. Brogan, attorneys for

<br />to wit:

<br />Mary Katherine Grimoldby (nee Boggs)

<br />James E.Boggs
<br />Marjorie Y.Cook (nee Boggs)
<br />That the said Esther A.Drake left surviving her the following children who are each of lawful agey
<br />to wit:
<br />Sidney P.Dr. ake,
<br />William A.Drahe,
<br />John D.Drake,
<br />Josephine Goettel (nee Drake)
<br />That the said Minnie Houghton who was joined in this suit as plaintiff under the name of Minnie
<br />Houghton, had intermarried with one Brown long prior to the commencement of this action, and she
<br />left surviving her at the time of her death, her daughter Ruth Houghton Brown, a minor over the
<br />age of 14 years, who resides at the town of Keller, Rainbolt County, Iowa,
<br />That the said children of the said deceased plaintiffs named in this motion, were all nephews and
<br />nieces of George H.Boggs, deceased, and they are now interested with the surviving plaintiff in
<br />i
<br />the administration of the trust as set forth in the amended petition herein, and found and decreed'
<br />by the Court, and they are now necessary parties to this action.
<br />Vrnorefore it is respectfully suggested that this Court proceed no further herein as to the inter-
<br />ests of the said deceased plaintiffs, and that an order may be made reviving the action in the
<br />name of said children of said deceased plaintiffs, and that proper notice be given to them of the
<br />order of the Court in relation thereto, and that oppurtunity be given to them to appear and plead
<br />herein as they may be advised.
<br />Jan. 9,1908 entered order of revivor as follows:

<br />Now on this day come John C.Cowin and Francis A.Brogan, attorneys for the surviving plaintiffs
<br />herein, and suggest to the Court the death of the plaintiffs Robert M.Boggs, Esther A.Drake and
<br />121nnie Houghton since the commencement of this action.

<br />;It appearing to the Court that the said Robert M.Boggs left surviving him the following named

<br />children of lawful age: Willaam Foster Boggs, Harris LeRoy Boggs, Mary Katherine Grimoldby (nee
<br />:Boggs) Robert M.Boggs, George H.Boggs, James E.Boggs, Marjorie M.Cook (nee Boggs).
<br />And that the said Esther A.Drake left surviving tier the following named children of lawful age:
<br />Sidney B.Drake, William A.Drake, John D.Drake Josephene Goettel (nee Drake). And that the said
<br />Minnie Houghton, whose name at the commencement of this action was Minnie Brown, left surviving
<br />her a daughter, Ruth Houghton Brown, a minor over the age of 14 years, who resides at the town of
<br />Keller, Rainbolt County, Iowa, it is ordered that this cause be revived as to the interests in the`
<br />subject thereof of the said deceased plaintiffs, in the name of their children aforesaid.
<br />it is ordered that the said children as above named be made parties hereto, and that they and each
<br />of them be permitted to appear herein and plead by joining with the plaintiffs or otherwise, as
<br />they may be advised.
