<br />March 8,1902 filed supplemental petition by Ida M.Wharton, formerly Ida M.Boggs, praying that
<br />Irving F.Baxter of Douglas County, Nebraska, may be appointed administrator with'the will
<br />annexed of said estate, to administer and settle the affairs of said estate in accordance

<br />with the terms and conditions of the said last will and testament of the said deceased. Said
<br />petitioner declines to serve as executrix or administratrix with the will annexed of the said
<br />estate, having since her appointment remarried

<br />March 8, 1902 entered decree. Recite, that on June 19, 1895 a petition for the probate of the last
<br />will and testament of said deceased was filed in this Court and on said date a written instrument,,- a
<br />purporting to be the last will and testament of said deceased was deposited in this Court. That'
<br />on Dec.2,1895 a hearing was had on said petition in said Court and a decree entered admitting
<br />said instrument to probate as the last will and testament of said deceased. ghat said decree
<br />was appealed from and at the September term 1896 of the District Court for Douglas County,:
<br />Nebraska, and said cause was brought on for trial before one of the judges of said Court and
<br />a jury and a judgment obtained by the proponents of said will. Said cause was taken on appeal'
<br />from the said District Court to the Supreme Court of the State of Nebraska, and at the January;
