LITHOGRAPH I.LG.STATIQNERY; OMFNG <br />DECREE:- WILL:- ETC: v <br />IN COUNTY COURT, DOUGLAS COUNTY, NEBRASKA. <br />1. <br />In the matter of the estate of George H.Boggs, deceased. <br />June 19, 1595 filed petition by Ida M.Boggs for probate of will. <br />petitioner shows that George H.Boggs, late of Omaha, Douglas County, Nebraska, departed this life <br />at Omaha, Douglas County, Nebraska, on June 1, 1595 leaving a last will and testament; that <br />petitioner is the widow of said deceased; that said last will and testament is now on file in <br />this Court, having been filed herein 6n June 13, 1595. That said deceased was at and immediately <br />previous to his death an inhabitant of said County of Douglas, and was possessed of real estate <br />in the State of Nebraska and also personal estate to be administered. <br />That the names, ages and residence of the heirs at law of said deceased, and other persons <br />interested in said estate are as follows: <br />NAIZFI <br />AGE <br />RESIDE11C E <br />RELATION <br />Robert Y.Boggs, <br />of age <br />Plainview, Nebraska, <br />brother <br />Margery Smullen, <br />of age <br />Boone, Iowa, <br />sister <br />Esther Ann Drake, <br />of age <br />Oil City, Penna. <br />aister <br />William F.Boggs, <br />of age <br />Boone, Iowa. <br />brother <br />Mary Fry, <br />of age <br />Boone, Iowa. <br />sister <br />Isabella Hoover, <br />of age <br />Boone, Iowa, <br />sister <br />John W.Boggs, <br />of age <br />Blair, Nebraska, <br />brother <br />James H.Boggs, <br />of age <br />Boone, Iowa. <br />brother <br />Lida Houghton. <br />of age <br />Coon Rapids, Iowa. <br />sister <br />and three children of <br />Emma <br />Houghton, deceased sister, whose names and ages <br />are not known, but <br />who reside at Boone, <br />Iowa, <br />and the petitioner, Ida M.Boggs, widow and sole <br />legatee and sole devisee. <br />petitioner prays that <br />said <br />persons and all <br />others interested in said estate <br />may be duly notified <br />three weeks prior to <br />the day of hearing to <br />show cause, if any there be, why <br />said instrument may <br />not be proved, allowed <br />and <br />probated as the <br />last will and testament of said <br />deceased and execution <br />thereof and administration of said estate be granted to this petitioner. <br />June 19, 1595 entered order assigning July.'15, 1395 at 9 A.M. for hearing said petition, notice <br />to be published in the Omaha Mercury three weeks successively prior to said day of hearing. <br />July 9,1395 filed proof of publication of notice of hearing on petition in the Omaha Mercury in <br />each issue thereof for three consecutive weeks, the first date being June 21, 1395 and the last <br />date July 5, 1595. <br />July 15, 1395 filed stipulation continuing hearing on probate of will to August 5, 1395 at 9 A,14. <br />July 15, 1395 entered order for leave to file objections and setting time for hearing petition <br />and objections to Sept. 17, 1395 at 9 A.T. <br />Aug. 5, 1895 filed objections to will. <br />Sept. 10, 1395 filed motion for continuance of hearing of petition and objections. <br />Sept. 17, 1595 entered order continuing hearing on petition for probate of will to Oct.1,1395. <br />Oct.1,1395 entered order continuing hearing to Nov. 11,1595. <br />Nov. 11,1595 entered order for continuance to Dec.2,1595. <br />Dec.2,1595 entered decree. It is ordered, adjudged and decreed that said instrument was duly <br />executed and that same is the genuine and valid last will and testament of George H.Boggs; that <br />the objections to the probate thereof be and the same hereby are overruled, and that the said <br />last will and testament be admitted to probate, allowed established and have full force and <br />effect as the last will and testament of said deceased and as a will of real and personal estate <br />and that the same be recorded as required by law, to which order, judgment and decree overruling <br />the said objections to the probate of said instrument the said contestants duly except and to <br />which order, judgment and decree admitting said instrument to probate the said contestants duly <br />except. <br />And the said. contestants having prayed that an appeal be allowed from this order, judgment and <br />
