<br />Now on this 5th day of. April, 10123 this cause came on for hearing upon the report of �

<br />Alcinda S.Dever, Administratrix of the estate of Hugh Dever, deceased, and it arlpearing to the
<br />Court from the proof on file, that all persons interested in the estate of said deceased have
<br />i I
<br />been duly notified and have entered their voluntary appearance herein and waived time and fur-
<br />ther notice and have asked t:e court to allow said reort as her final account in accordance
<br />with the prayer of the said administratrix, and after a full examination thereof the Court finds
<br />that said report is correct in all respects and ought to be approved and allowed as and for the
<br />final account of said Alcinda. S.Dever, Administratrix, and it is, therefore,
<br />ORDERED, ADJUDGED AND DECREED that the account of Alcinda S.Dever, administratrix, be and
<br />the same hereby is approved and allowed as her final account..
<br />The Court finds that due and legal notice was given all ?persons of the time limited and
<br />.-lace appointed for filing claims against said esta e, as required by law and the order of court
<br />i
<br />dated August 2nd, 1911, that the time limited for iling claims has fully exrired; that all
<br />claims filed and allowed have been fully paid and satisfied; that all claims outstanding against
<br />I
<br />said estate and not so presented and within the timn, allowed by the court for filing claims, are
<br />forever barred and excluded.
<br />It is therefore considered and adjudged by the court that all persons. are forever barred
<br />1 from filing or setting up any claims or demands a,r.,ainst t o estate of Hugh Dever, deceased, and
<br />said: estate is fully settled and closed. It is found that said Hugh Dever died on the 1st day
<br />of July, 1911.
<br />The Court finds that the said Hugh Dever left surviving him as his Heirs at lav, and his
<br />only heirs at law, the follo',aing named persons: I ALCIITDA' S.DEVEP, his widow, and REITTCN S.
<br />DEVER, JCHN F.DETTER and FRANK H.DMYERi his children
<br />The Court finds that the said Hugh Dever was at the time of his death the owner of the
<br />following described real estate situate in the County of Hall and State of Nebraska, to-wit:-
<br />LOTS 4 and-5 in Block 12 in Evans Addition and Lots 5 and 6 in Block 9 in Lar:bert's Addition
<br />all in the City of Grand Island, and that under the l law of the State of 1ebraska, all of, such
<br />real estate did - ass and descend at the death of the said Hugh Dever, intestate, to the above
<br />named heirs in the manner following:- To Alcinda S.Dever, his widow, one -third ^art thereof
<br />in fee; to Renton S.Dever, John F.Dever and Frank ..Dever, his sons, the remaining two- thirds
<br />Part thereof in fee , subject to the homestead righ s of the said Alcinda S.Dever in and toal
<br />estate.
<br />The Court finds that the one -half interest o
<br />note for 2000.00, secured by mortgage, became the
<br />thereof going to Alcinda S.Dever and 2/3 hart there
<br />Frank r: .Dever, in equal shares.
<br />It is therefore considered by the court that t
<br />the said Hugh Bever in a certain promissory
<br />o -perty of said heirs at his death, 1/3 part,,,
<br />going to Benton S.Dever, John F . Dever and
<br />above describ =d real estate situate in
<br />the City of Grand Island, in Hall County, 14'eb-raska, Idid descend at file death of the said Hugh
<br />Dever, by virtue of the law of Nebraska, to the abo e named Alcinda S.Dever, Benton c .Dever, John
<br />F .Dever and Frank H -1:11e .Dever in accordance ,iith �_e ab ve -`indings of the court.
<br />It ..is found by the Court that the said Hugh Dever was at the time of his death the owner of
<br />four hundred and fifty acres of land lying on Alleghany 1;11ountain, on the east side of Knoppe
<br />Creek in Pocahontas Coiinty, Nest Virginia, and more Irarticularly described as follows:-
<br />Beginning at ah. Elm stump on the bank of Clover Field Run ( ol(l corner) thence with the old
<br />lines S.42'- F. 103 poles to a chestnut and 2 fallen r°:anles, S.64 E. ^6 poles to axed oat. and
<br />locust, S. `46� E. 334 holes to a hemlock and cucurmb r, `'.521 F. 364 poles to a double red oak
