<br />part and his said wife for which reason they have consented and agreed and do hereby consent and
<br />agree to live separate and apart from each other during their natural lives:
<br />1. THEREFORE THIS INDENTURE WITNESSETH: That the party of the first part in consideration of the
<br />premises hereinafter contained and in pursuance thereof, does hereby covenant, promise and agree
<br />to and with his said wife, that it shall and will be lawful for her his said wife at all times
<br />hereafter to live separate and apart from him, and that at her free will she is hereby permitted
<br />and allowed to travel or go from place to place whereso ever she may please without any let or
<br />hinderance on his part and to carry on such business and buy and sell such real or personal prop -
<br />erty as she may from time to choose, or think fit, and that he will not at any time sue or suffer
<br />her to be sued for living separate and apart from him, nor will he compel hereto live with him or
<br />sue or molest or trouble any other person for receiving, entertaining or harboring her, and that
<br />he will not without her consent, visit or knowingly enter any place or house wherein she may be or
<br />may reside.
<br />2. IT IS FURTHER AGREED that the said Margaret G.Drake will not hereafter ask E.Ray Drake for any support
<br />or maintenance, except as herein provided, that she will not apply to any Court or Courts to compel
<br />him to live with her, to support her in any manner other than herein provided, or to continue the
<br />marital relation with her in any manner whatsoever, and that she will not on her part enter any
<br />house or place wherein she knows him to be temporarily or permanently without his consent.
<br />3. As one of the considerations hereof, the party of the first part agrees to pay to the party of
<br />the second part the sum of Six Hundred dollars (4600.00) as follows: Five Hundred dollars 3500.00)
<br />cash in hand paid, the receipt whereof is hereby acknowledged, and One Hundred Dollars ($100.00)
<br />on or before six months from this date. The said One Hundred Dollars to be evidenced by note for
<br />One Hundred Dollars drawing six per cent interest, dated this date, and due on or before six months
<br />:=
<br />from this date. And also one Singer sewing machine now in the room of said parties at 222 east
<br />13th Street, being the premises hereinafter described.
<br />4. AND WHEREAS the home of said parties, to —wit:— the residence upon Lot 10 Block 69, in wheeler
<br />& Bennetts 2nd Addition to Grand Island, Hall County, Nebraska, now stands of record in the name
<br />of the party of the first part, the said Margaret G.Drake, in consideration of the premises herein
<br />does hereby grant, sell and convey unto the said E.Ray Drake all of her right, title, interest,
<br />claim in and to the said land last hereinabove described to have and to hold the same unto the
<br />Said E.Ray Drake with all the tenements and appurtenances thereunto belonging hereby relinquishing
<br />her right of homestead and all other rights that she may now have or hereafter acquire unto the said
<br />E.Ray Drake and to his heirs forever.
<br />5. AND WHEREAS the party of the first part owns sundry and divers articles of household furniture
<br />located in their home, and also in the room that had been occupied by them at 216} West 3rd Street,
<br />it is hereby agreed and understood by and between the parties hereto that each and all of the
<br />articles of said household furniture, save and except the one Singer sewing machine herein above
<br />named and set out above and do from this date belong to and be the sole and exclusive property of
<br />E.Ray Drake.
<br />6. AND IT IS FURTHER AGREED that each of the parties hereto and especially Margaret G.Drake, shall
<br />and will at all times hereafter, upon reasonable request, and at the Notarial cost and charges to
<br />be paid her for making out said papers, will make, do, execute all and every other further conveyances
<br />or deeds for the better or more effectually vesting and confirming of the title to the premises ,
<br />which are hereby granted or intended to be granted to the said E.Ray Drake, which the said E.Ray Drake,
<br />,or his attorney shall reasonably devise, advise or require. And the said Margaret G.Drake, on the
<br />part of herself and her heirs, hereby covenant to warrant and defend the title to the said premises
<br />herein granted against the lawful claims of all persons whomsoever, forever.
<br />7. And the said Margaret G.Drake hereby agrees to and does hereby waive any and all rights, claim
