<br />,memory, do hereb37 make, publish and declare this codicil to my last will and testament, hereto-
<br />,fore made by me, bearing date of Novenfoer 15th, 190-0.
<br />First: It is ray will and I so declare that in case of the death of any of the legatees i
<br />named in the third clause of my said grill, leaving issue or descendants, prior to my death or the �
<br />cleatli of my said wife named in said .will, then anti in such case, the legacy given to such legatee
<br />as set forth in said third clause of my said will shall be paid to such issue or descendants
<br />in equal shares as provided by the law of descent in the State of Nebraska, but in case any of
<br />,'said legatees should die prior to the death of myself or my said wife, without leaving issue or
<br />!descendant, then her share shall lapse and become a part of the -residuary of my said estate.
<br />Second : - It is my will and I direct, and especially provide, that in case any of the lega-
<br />tees or devisees, or their heirs, named in my said .rill, shall contest same or file any suit, at
<br />law or otherwise, to contest the probate of my will or of this codicil, or to set aside, change
<br />'or modify its contents in any way, then in sect event, I direct that such contestants, whether,
<br />;devisees, legatees or their heirs at law shall not take or receive anything under my said will
<br />?or under this codicil, out that the share or shares of such contestant or contestants, as set
<br />;;forth in my said will, or in this codicil, shall, in case of such contest being filed or suit
<br />i
<br />started, by or through them, lapse and become a part of the residuary of my said estate and be
<br />"divided among the other non- contesting residuary legatees and devisees and their heirs, as prov-
<br />"1ided in the sixth clause of my said will, the intention being,. by this clause, to preclude any
<br />and all �,ontestants of my said will from receiving or taking any part of my property through its
<br />;provisions.
<br />Third : - It is my will
<br />^ln case of the death of my said wife Wilhelmine Frederika Stolley,
<br />before my death, or before ray estate is finally settled, that Oscar Roeser, husband of my daughter
<br />Minna Roeser, and ray son Emil Stolley shall act and be appointed by the Probate Court having the
<br />ettla:aent of my estate, as executors of my said will and this codicil, and I name nominate
<br />,! and appoint them as such executors to act in the case of the death of my said wife as above stated
<br />The above are the only modifications or changes I desire to make in any manner in my said
<br />'! _.ast will bearing date of November 15th, 1906.
<br />In witness whereof I have hereunto subscribed my name to this codicil, to my last will and
<br />testament, consisting of two pages of type:vritten matter, both of which I have identified with
<br />my signature thereon on this 24th day of January 1910.

<br />e ach of us, and declared at the same time in our presence and hearing that this instrument was a
<br />codicil to his last will and testament, dated November 15th, 1900, and ,.we at his request, and in
<br />'leis presence and in the presence of each other, sign our names hereto as attesting witnesses, and
<br />re certify that the words "non - contesting" inserted in the first line on this page was inserted
<br />on re -nest of testator before he signed same.

<br />Now on this 26th day of February.1912, this cause came on for final hearing upon the
<br />;report and petition of lilhelmine Frederika Stolley, executrix of said estate, for a settlement
<br />thereof, and it appearing , from the proofs on file in this Court, that legal notice , as by law
<br />,'and the orders of this Court required, has been given to all parties interested in said estate
<br />of the filing of said report and petition and the time for hearing thereon, and there being no
<br />loon and the Court, on examination thereof, finds that same is, in all respects,
