<br />The Court finds that the said Theodore Scherzberg, deceased, left surviving him as his heirs
<br />at law, and his only heirs at law, the following named persons:
<br />EDWARD SCHERZBERG , CHARLES SCHERZRERG , THEODORE SCHERZBERG and EMIL SCHERZBERG, his sons,
<br />and ALVINA CORDS and MINNIE SCHERZBERG, and Olga Wilhelmi his daughters.
<br />It is found by the Court that the said administrator has made distribution of the personal
<br />prDperty.remaining in his hands after the payment of debts and expenses, among the above named
<br />heairs , paying to each the sum of X1521.37.
<br />The Court finds that the said Theodore Scherzberg was at the time of his death the owner of j
<br />the following described real estate situate in the County of Hall and State of Nebraska, to -wit:
<br />The Westerly 49 feet of Lot Three (3) in Block Seventy Eight (78) in the original to•wn1 of Grand
<br />Island, and that under the law of descent of the State of Nebraska said real estate did pass and
<br />descend at his death to the said Edward Scherzberg, Charles Scherzberg, Alvina Cords, Olga
<br />lilhelmi, T'- .eodore Scherzberg and Emil Scherzberg and Minnie Scherzberg in equal shares, to have
<br />and to hold to them and their heirs and assigns forever.
<br />It is therefor adjudged and considered by the Court that the above described real estate
<br />did pass and descend at the death of Theodore Scherzberg to the above named heirs in fee and as
<br />tenants in common in accordance with the findings herein.

<br />Now on this 6th day of December, A.D. 1911, this cause came on for hearing upon the
<br />report of Charles J.Hur:zphrey, Charles H.Kindig and Fred Harrell, the referees heretofore appoi-
<br />nted and commissioned to make partition herein, and was submitted to the Court, and the Court
<br />Having examined the same and being fully advised in the premises, finds it to be correct, and
<br />that partition has been duly made by the said Charles J. Humphrey, Charles H.Kindig and Fred
<br />Harrell, referees, in this action in conformity to law and the orders of this Court, and the
<br />same is hereby arrroved and confirmed.
<br />It is, therefore, ordered, adjudged and decreed, by the Court, that the partition of the
<br />East half of the Southwest quarter of Section Number Ten (10) in Township Number Nine (9), North
