<br />At a Session of the County Court held in and for said County, at the County Court
<br />Room in the City of. Hastings, County of Adams and State of Nebraska.
<br />Present: William F.Button, Judge of the County Court.
<br />In the Matter of the Estate of DECREE OF FINAL ACCOUNT
<br />AND
<br />Elizabeth Rainforth, Deceased DISTRIBUTION OF ESTATE.
<br />Now on this 6th day of October ,1911, this cause came on to be heard upon thetition
<br />of Miles C.Rainforth, Administrator with the Will annexed of the estate of Elizabeth Rainforth,
<br />deceased, praying for the examination and allowance of his account and for his discharge as such
<br />Administrator, and is submitted to the Court, upon consideration whereof, the Court finds from
<br />the records, the proofs on file and the evidence :-
<br />1. That on said day the Court made an order that hearing be had forthwith, it appearing
<br />to the Court that all the heirs at law of said Elizabeth Rainforth, deceased, have filed their
<br />voluntary appearance and waived the issuance and service of notice of hearing.
<br />2. The Court further finds that the said Elizabeth Rainforth departed this life testate,
<br />on the 22nd day of December ,1910, at her home in Hastings, Adams County, Nebraska, being at the
<br />time of her death and for a long time prior thereto a resident and inhabitant of said County and
<br />State.
<br />3. That on the 12th day of January, 1911, Thomas R.Rainforth and Albert P.Rainforth by
<br />their attorney, Jno Snider filed in this Court a paper (writing purporting to be the last Will and
<br />Testament of Elizabeth Rainforth, deceased, also filed petition praying for the probate of said
<br />instrument and that letters of Administration with the will annexed might issue to Miles C.
<br />Rainforth.
<br />4. That on said day all the heirs at law. legatees and devisees under said will filed
<br />their voluntary appearance, wavved the issuance and service of notice and the Court made an order
<br />that hearing be had on the 17th day of January 1911, at 3 o'clock P.M., without further notice.
<br />5. That on the 17th day of January, 1911, hearing was had, proofs taken and a decree of pro-
<br />bate duly executed, proving, approving, probating and allowing said instrument as the last Will
<br />and Testament of the said Elizabeth Rainforth, deceased, and directed that Letters of Administta-
<br />tion with the Will annexed should issue to Miles C.Rainforth upon his filing bond in the sum
<br />of $50,000.00 with sureties to be approved by the Court and taking and filing the oath required
<br />by law.
<br />6. That the said Miles C.Rainforth on said day duly qualified by filing bond with sureties
<br />which was approved by the Court and takinZ and filing the oath required by law, and thereupon
<br />Letters of Administration with the Mill annexed Were duly issued to him and he entered upon the
<br />discharge of his duties as such Administrator.
<br />7. That on said day the Court made an order fixing the 11th day of February 1911, at 10
<br />o'clock A.M. at the County Court Room in Hastings, Nebraska, as the time and place for the filing
<br />examination and adjust mgnt of claims against said estate and directed that all claims not filed
<br />on said day, so limited, or within six months thereafter should be forever barred and further
<br />directed that notice of such order should be given by the publication of a copy thereof in the
<br />Hastings Daily Republican, a nwssnaper printed, published and of general circulation in said
<br />County for four weeks prior to said day of hearing.
<br />8. That notice was given by the publication of a copy of said order in the Hastings Daily
<br />Republican, as directed, and that proof of the due publication thereof Was filed with thj *6 Court
<br />on the 7th day of March,1911.
