<br />all of the rest and x•esidue of my estate of whatsoever nature and kind, to be held by him -:IN
<br />TRUST, upon the following TRUSTS:
<br />let. To i,,ay out of the same all the expenses of maintaining the same, and Administering
<br />the said trust;
<br />2nd. To deposit in Bank to the credit of my *aife during her life, for her own use, all the
<br />net rents, issues and profits thereof, such deposit to be made d-ily 1-s said rents, issues and
<br />profits are received or collected.
<br />3rd. On the renuest in writing at any time or times of my said wife to sell any part thereof
<br />and to deliver to her., for her own use absolutely, the proceeds of such sale, or otherwise invest
<br />the same in the name of said trustee and for the purposes herein specified as she may direct;
<br />4th. Upon the decease of my said wife r said Trustee shall without unnecessary delay divide
<br />whatever of my said estate shall be then remaining in this trust equally, share and share alike,
<br />between my brothers and sisters in case of the death of any of them before such division,
<br />leaving issue, such issue to take the deceased parent's share; and in case no issue be left, then
<br />such ,hare to go to the survivors of my said brothers and sisters, issue taking by representation
<br />as above provided; the issue of my sister Emma Houghton, no;,,; deceased, to take their mother's share.
<br />5th. My said wife shall have power to fill any vacancy created by the death, refusal to act.,
<br />or removal of said trustee; and she shall have power to remove,, with or without cause, sflid trustee
<br />or his successor., upon appointing another trustee to fill his place.
<br />6th. The said trustee 111hall not have power to convey any of the said trust estate, during
<br />unless, she join with him in the execution of the conveyance thereof, and
<br />my said wife's life, P
<br />her so joining shall be conclusive evidence of the giving of the request named in the above plarag-
<br />raph.3.
<br />7th. The said trustee sh.-111 annually file in the probate court probating this will) a report
<br />showing the det �.ils of the 7dmindstratism of this trust.
<br />8th. Every trustee under this trust shall give to the Probate Judge of the Court probating
<br />this will a bond, to be approved by said court, in the sum of tine Thousand Dollars (q1000.00)
<br />conditioned upon the faithful execution of his duties as such trustee.
