<br />The Court further '"finds that on or about the 22nd day of July 1879 one Charles Arch, then
<br />beinju the owner of the said Fast half oP the Southeast �,uarter of Section number Thirty-two(32)
<br />in Township Number Twelve (12) North of Range Number Nine (9) west of the Sixth (6th) P.M.,
<br />and situated in Hall County, Nebraska, made ,executed, acknowledged and delivered to the defen-
<br />dant Lysander ^nsign, as and in the name of H.Lysander Ensign, a mortgage upon the said premises
<br />for $450, which said mortgage was on the 23rd day of July 1879 duly recorded in the Office of
<br />The County Clerk of Hall County, Nebraska, in Book "F" of Mortgages, at page 344 of the mortgage
<br />records of said County, that said mortgage and the obligation for which the same was given had
<br />been fully paid and satisfied and that said mortgage ought as a matter or right to be released
<br />cancelled and satisfied of record.
<br />It is therefore ordered, adjudged and decreed by the Court that said mortgage from Charles
<br />Arch to the said H.Lysander ^nsign for It450. iipon the said East half of the Southeast quarter
<br />of Section Number Thirty -too (32) in To- vnship Number Twelve (12) North of Range Nine (9) West
<br />of the Sixth (6th) P.M. , and situate :l in Hall County, Nebraska, which sai =l mortgage is recorded
<br />in Book "F" of 1-viortgages at page 344 of the 'Mortgage records of sail County, be and the same here
<br />by is released, cancelled and satisfied of record, and as to said mortgage plaintiffs title to
<br />said premises is quieted and confirmed in her as against the defebdant Lysander Ensign, also
<br />known as H.Lysander Ensign and H.L.Ensign, and as against all persons claiming by, through or
<br />under him.
<br />The Court 1'i..xrther finds that on or about the 29th day of September 1892 one Frank A. Curtis
<br />then being the owner of the said Fast 111al `" of the Southeast -quarter of Section Number Thirty -
<br />t^ro (32) in To,7nshir number T-, -elve (12) north of Range Number Nine (9) Vest of the Sixth (6th)
<br />P.M., and situated in Hall County, Nebraska made, exxecuted, ackno ,1^ledged and delivered to one
<br />Horace Tarbox, now deceased, a mortgage upon said premises for the sum of 2600. Which said
<br />mortgage -gas duly -rer�orded in the Office of the County Clerk of Hall County, Nebraska, in Book
<br />"N" of Mortgages, at sage 550 of the mortgage records of sa.i,l County, That said mortgage
<br />and the obligation for ,.rhich the same was given to secure was fully paid to the said H�)race
<br />Tarbox :luring his life time an: on or about the 23rd day of September 1893, and that said mortgage
<br />ought as a rr:atter orri ?ht to be released, cancelled and satisfied of record.
<br />The Court further finds that the said Horace Tarbox died testate in the year 1898 in Hall
<br />County, Nebraska, that his last Till and tcota:!)ent was duly proven, allowed and admitted to pro
<br />bate in -the County Court of Hall County, Nebraska, that the said Mary D.Tarbox, administratrix
<br />with the gill annexed of the estate of Horace Tarbox, deceased, was the duly appointed gmalified
<br />and acting a lminist-ratrix ;-ith the -,,ail]_ annexed of the estate of Horace Tarbox, deceased.
<br />That the �-ersonal estate of the said Horace Tarbox, deceased, was disposed of under the
<br />residuary clause in his last will -nd testament and that the defendants Mary D.Tarbox and Horace
<br />Tarbox, Jr., Winnifred 0.111arbox, Pessie Tarbox and Ruth Tarbox were the residuary legatees and
<br />allof the residuary legatees ender the last will and testament of the said Horace Tarbox, deceased
<br />It is therefore �rcle.re 1, adjudged and decreed by the Court that the mortgage from Frank A.
<br />Curtis to Horace Tarbox for "2600 upon the said East Half of the Southeast quarter of Section

<br />Sixth (rth) P.M. , and situated in Hall County, Ne-�raska, - =rhich said mortgage is recorded in Book

<br />hereby is released, cancelled and satisfied of record, and as to said mortgage, plaintiff's .
<br />title to said premises is quieted and confirmed in her as against the defendants Mary D.Tarbox,
