<br />And ujon the same day the said Will was opened and read and Monday the 16th day of November
<br />1908 was set for final hearing and proof of the same and notice of said hearing to publish in the
<br />Times Herald a weekly newspaper published in said County.
<br />Aimd afterwards, to -wit: 1kov. 16,1908, there was filed in said office of the Clerk of the
<br />District Court a proof of publication of the Notice of Hearing, together with affidavit of
<br />the publisher of the Times Herald, a weekly newspaper published in said County, and said af-
<br />fidavit is in words and figures as follows: to -r:it: -

<br />NOTICE OF PROOF OF WILL.
<br />An instrument in writing purporting to be the Last Will and Testament of Maggie
<br />Wartman,, deceased, late of Cerro Gordo County, Iowa, having been filed, opened and read,
<br />Monday, the leth day of November, 1908, is set for day of hearing final proof of same.
<br />You will therefore appear or or before noon of the said day and show cause, if any exists,
<br />!rhy said instrument should not be admitted for probate and record.
<br />Witness my hand and seal of the District Court this 6th day of October, 1908.

<br />The undersigned being duly sworn, says that he is publisher of the Mason City Times -Her-
<br />ald, a weekly newspapet of general circulation regularly published and printed in the En-
<br />glish Language at Mason City, in Cerro Gordo County, Iowa, and the affiant further says th*tt
<br />a notice, a copy of Mich is hereto attached, and made a part hereof, was published in said
<br />newspaper for three issues, the first publication of said notice being made on the 13th day
<br />of October, A.D.1908, the second on the loth day of October A.D.1908, the third on the 27th
<br />day of October, A.D.1908, and the fourth on the day of A.D.19 -.

<br />BE IT REMEMBERED, that on the 17th day of November, A.D.1908, it being the second day of
<br />the Regular November tern: of the District Court of Iowa, in and for Cerro Gordo County, pre-
<br />sent the Hon. C.H.Kelley, sole presiding judge, E.F.Clark, Clerk of said Court and A/ tHol-
<br />dren, Sheriff of said County, pursuant to notice, duly published by said clerk, proof being
<br />on file, the Deposition of J. C. Raymond one of the subscribing witnesses o the said Last
<br />Will and Testament of Maggie Wartman late of Cerro Gordo County, deceased, and said J.C.
<br />Raymond, being duly sworn on oath declared that the said instrument was at the date there-
<br />of, to -wit: Oct.6,1900 signed and sealed by the said testator, who then and there acknowl-
<br />edged and declared the same to be her last Will and Testament in the presence of Frederick
<br />M. Curtiss and J. C. Raymond subscribing witnesses thereto: that the said subscribing wit-
<br />nesses thereto did then and there in the presence of the said Maggie Wartman, deceased,
<br />severally subscribe,said instrument as witnesses thereto; and that at the time of the exe-
<br />cution of said instrument the said Maggie Wartman deceased was of sound disposing mind and
<br />memory, of full age , and under no . restraint to the best of the said witnesses' knowledge
