<br />grant and bequeath the same as follows:
<br />To my son Frank A. Wartman, the sum of four thousand dollars ($4000.001 i

<br />�. , wife of S. D. Drake, and Susie E . ' wife of J. J. Ryan, and
<br />Luella, the wife of J. H. Eastman, I will the balance of said estate, share and share alike.
<br />Paragraph 5. Shoo ld any of my children, legatees named, die before said distribution, leas-
<br />ing no heir or heirs of their body, then his or her #W# or their share shall be distributed
<br />among my surviving named legatees, in the respective proportion to each surviver herein nam-
<br />ed until said share or shares are exhausted; however should any of my said children, legatees
<br />die before said distribution, leaving an heir or heirs of their body, such heir or heirs of
<br />said decease c�legatee, shall receive and inherit the share of said deceased legatee, share
<br />and share alike. It being my desire and my will that my said estate real and personal be
<br />distributed to each of said legatees in their proportion aforesaid; said estate being more
<br />or less than the standard therein fixed, to.v:it -: the sum of nine thousand dollars ($9000.

<br />Paragraph 4. The piano, clothing and household goods are exeepted and not included in
<br />the bequest heretofore made; it being my will that the same be distributed among my named j
<br />children as follows;
<br />The piano I give and bequeath the use of the same to my daughter Susie E., it being my
<br />desire that said piano remain in the Wartman family. I give my said daughter Susie ro right
<br />to sell or dispose of the same. In the case of the death of mja said daughter, Susie, then,
<br />and in that case, if the same should occur, my son Frank A. Wartman, shall have said piano,
<br />and in any event, whenever an heir is born to one of my said children legatees, it being

<br />the intent of my will that the first child and heir of the body of either of mit said children, {
<br />legatees, shall have said piano absolutely.
<br />Paragraph 5. My clothing and household furniture I desire to be distributed among my chil-
<br />dren, legatees, share and share alike.
<br />Paragraph 6. My said children having heretofore unitedly presented me with a gold watch,
<br />which I hold as a keepsake from all of my said children, all of whom are alike dear to me,
<br />hence I have no choice as to which one shall receive it; I theref®re will said watch to all
<br />of my said children,jointly, giving them the right and privilege of disposing of the same
<br />as they may choose.

<br />Paragraph 7. In making the foregoing distribution of my property, I have taken into con -
<br />sideration the financial condition of all of my said children, and have made said bequests
<br />i
<br />as I believed to be just and right; all of my said children being equally dear to me.
<br />Paragraph 8. I hereby nominate and appoint my said children Minnie E., Susie E., Luella,
<br />and Frank A. Wartman as executors of this , my last will and testament, with full power and
<br />authority to carry out the provisions of said will, and further, it is my desire that no

<br />bond shall be exacted from ##fff## them, or 4rither of them. It is my desire and I enjoin
<br />all of them to consult one with the other and do all things for the best interests of all.
<br />Paragraph 9. I hereby revoke all former wills or codicils heretofore made by me, and can-
<br />eel and destroy the same.
<br />Witness my hand and signature hereunto affixed, this 6th day of October, A.D.1900 , at
<br />Algona, Iowa.
