<br />James W. Smith, deceased.
<br />Now on this 16th day of April, 1910, this cause came on for!
<br />hearing upon the final report of Nancy A. Smith, Adrr:inistratrix of the Estate of James W. Smith,
<br />deceased, and it appearing to the satisfaction of the Court that all persons interested in the
<br />estate of said deceased have been duly notified of the filing of said
<br />r
<br />report and of the time and place fixed for the hearing thereon and have entered their voluntary
<br />appearance herein and waived further notice by publication or otherwise, the court proceeded to
<br />examine said report. After a full examination the Court finds that said report is correct in a11j
<br />,,respects and ought to be approved and allowed.
<br />It is therefore ORDERED, ADJUDGED AND DECREED that the report of Nancy A. Smith, Administra- j
<br />y trix be and the same is hereby approved as and for her final account and she is discharged of her
<br />a trust. The Court finds that due and legal notice was given to all persons of the time allowed anti
<br />place appointed for filing claims against said estate and that the time allowed for presenting
<br />claims has fully expired; that all claims filed and allowed against the estate of James W. Smith;
<br />have been fully paid and satisfied; that all claims outstanding against said estate, if any there;
<br />be, are therefore forever barred and excluded, j
<br />It is therefore Considered and Adjudged by the Court that all persons are forever barred and
<br />precluded from filing or setting up any claims-or demands against the estate of James W. Smith ano
<br />said estate is fully settled and closed.
<br />The Court finds that the said Administratrix has fully accounted for all of the estate which
<br />came into her hands, has paid all debts, funeral expenses and costs of administration and has
<br />distributed the balance of the personal property according to law and the wishes of the legal heirs
<br />as expressed by their written request filed herein.
<br />The Court finds that the said James 7% Smith departed this life on the 25th day of July, 1909, j
<br />intestate, leaving the following named persons as his heirs at law, and his sole heirs at law:
<br />Nancy A. Smith, his widow, and Emma J. Snearly, Orville L. Smith, Charles W. Smith, George N
<br />Smith, Laura E. Smith, Albert B. Smith, Clara C. Smith, his children.
<br />The Court finds that the said James W. Smith was at the time of his death the owner of the
<br />following described real estate situate in the County of Hall and State of Nebraska, to -,�it:
<br />The "South -east quarter of Section 22, in T.ormship 9, in Range 9, and that under and by virtue
<br />of the lair of descent of the State of Nebraska, said real estate did pass and descend at his
<br />death in the manner following: One -third part thereof to Nancy A. Smith, in absolute title; and
<br />the remaining two- thirds part thereof to Emma J. Snearly, Orville L. Smith, Charles W. Smith,
<br />George H. Smith, Laura E. Smith, Albert B. Smith and Clara C. Smith, in equal shares and in abso-
<br />lute title. It is therefore Considered and Adjudged by the Court that the SE-1 of Section 22,
<br />in Town 9. Range 9, in Hall County, Nebraska, did descend at the death of James W. Smith, in the
<br />manner following: to Nancy A. Smith 1 -3 part thereof, and to Erria J. Snearly, Orville L. Smith,
<br />Charles W. Smith, George H. Smith, Laura E. Smith, Albert E. Smith and Clara C. Smith, as tenants
<br />in_ conuiion, 2 -5 part thereof, to have and to hold to there and their heirs and assigns forever.
