<br />All the rest, residue and remainder of my estate whatsoever character and wheresoever situated
<br />including also any of the foregoing legacies which may have lapsed, I give, devise and bequeath
<br />to my nephews and nieces, the children_ of my brothers and sisters, to be equally divided among
<br />them, share and share alike to them, and to their heirs and assigns, to have and to hold forever,
<br />each of my nephews and nieces taking his or her proportionate share of the whole of said resid-
<br />uum in proportion to the whole number of such nephews and nieces.

<br />I hereby nominate and appoint Joseph R. Kingman of Minneapolis, Hennepin County, Minnesota,
<br />to be the Executor of this my last Will and Testament and to enable him to carry out the bequest
<br />hereinbefore made, I authorize and empower him to sell and convey any and all real estate whereof!
<br />I may die seized, without application to the Probate Court for leave so to do and without
<br />im)osing upon the purchasers thereof any obligation to inquire into the application of the j
<br />I
<br />purchase money of said or any properties so sold. And it is my will that my said executor shall i
<br />not be required to pay the legacies hereinbefore made or to distribute the residue of my estate
<br />at any time earlier than three years from the date of my death unless he shall deem it for the
<br />best interest of the estate so to do. i

<br />I hereby revoke all wills by sue heretofore made.

<br />Be it Remembered, that at a term of the Probate Court for said Hennepin
<br />County, held at the City of Minneapolis, in said County, on Wednesday the 16th day of December,
<br />1908, and pursuant to notice duly given as required by law the instrument hereto annexed purport-
<br />ing to be the last Will and Testament of Carrie C. Moods, late of the County of Hennepin and
<br />State of Minnesota, deceased, was duly proven to be the last will and testament of said deceased,
<br />duly executed as required by law, and valid as a will of real and personal property in the State
<br />of Minnesota by the testimony of Thomas F. Wallace, one of the subscribitg witnesses to said Will
<br />no one appearing to contest the probate thereof.
<br />The said instrument is therefore adjudged to be in all parts duly executed as the last will and
<br />testament of said deceased and is as such last will and testament admitted to probate and to
<br />record jay this Court.
<br />It is further Ordered, that Letters Testamentary issue to Joseph R. Kingman, of Minneapolis,
<br />Minnesota, herein upon his filing in this Court hidbond in the penal sum of Five Thousand Dollars,
<br />frith sufficient sureties to be approved by the Judge of this Court, conditioned for the faithful ii
<br />ti
<br />discharge of all the duties of his said trust, according to law.
<br />In Witness Whereof, I, George R. Smith, have hereunto subscribed my name as Judge of Probate
<br />and affixed the seal of said Court at Minneapolis, in said County, this 16th day of December, 1900.
