<br />Joseph Roach, deceased, )
<br />Now on this 14th day of November, 1908, this cause came on
<br />for hearing upon the final report of Kate Roach, Administratrix of the Estate of Joseph Roach,
<br />deceased, and it appearing to the satisfaction of the Court that all persons interested in said
<br />estate have been notified by publication of the filing of the said report and of the time and
<br />place fixed for the hearing thereon, as required by the order of this Court, dated November 5th,!
<br />I
<br />1908, and no one appearing to object and there being no protest on file, whereupon, after a full)
<br />examination, the Court finds that said report is correct in all respects and ought'to be approved
<br />and allowed. The Court finds that the said Administratrix has collected the sum of 13390. 11

<br />I
<br />and has paid out and distributed the sum of 1186,76, leaving a balance in her hands of $2203.351
<br />and that after deducting the sum of $50 00 commission due the Administratrix, there remains for
<br />distribution the sum of $2153 35.
<br />I
<br />It is therefore, Ordered, that the account of Kate Roach, Administratrix, be and the same
<br />i
<br />hereby is approved and allowed as and for her final account and that upon her filing in this
<br />i
<br />Court the receipts of the heirs for their distributive shares of the funds now in her hands she
<br />I
<br />is discharged of her trust and her bond cancelled.
<br />The Court finds that notice was given creditors by posting and by publication, of the
<br />time allowed and place appointed for filing claims against said estate; that the time so allowed;
<br />has fully expired; that all claims filed and allowed have been fully paid and satisfied; that
<br />all claims against said estate not presented, if any there be are barred and excluded.
<br />It is therefore Adjudged that all persons are forever barred from filing any claim or claims
<br />I
<br />against the estate of Joseph Roach, deceased and said estate is fully settled and closed,
<br />The Court finds that the said Joseph Roach left surviving him as his heirs at law, the
<br />following named persons: Kate Roach, his widow, and Marion Roach Scott and William C. Roach,
<br />this children, and that said heirs are entitled to share in the personal estate as follows:
<br />part to the widow, and 3 -8 part to each of the children, The Court finds that the said Joseph j
<br />Roach was at the time of his death the owner of the following described real estate situate in
<br />I
<br />the County of Hall and State of Nebraska, to -wit: The East half of the South -east quarter of
<br />i
<br />section 12, Township 10, Range 11; the East half of the North -east quarter of Section 13,, Town-
<br />. �
<br />ship 10, Range 11, and the South -east quarter of the South -west quarter of Section 11, Tovinhip
<br />11, Range 10, and that under the laws of the State of Nebraska, all of the said real estate did
<br />pass and descend at his death as follows: part thereof to Kate Roach, the widow, 3 -8 part to
<br />I
<br />Marion Roach Scott, and 3 -8 part to William C. Roach, subject to the homestead right of Kate
<br />Roach therein. It is therefore considered and Adjudged that the EJ of SE- of Section 12, Town
<br />i
<br />10, Range 11; the EJ of NE� of Section 13, Town 10, Range 11, and the SE- of the SW� of Section
<br />11, Township 11, Range 10, all in mall County, Nebraska, did descend on the death of Joseph
<br />Roach, intestate, to his widow and children as follows: One fourth to Kate Roach and the
<br />i
<br />remaining three fourths in equal shares to Marion Roach Scott and William C. Roach, to have and I
<br />to hold to them and their heirs and assigns forever subject to the homestead right of the said
<br />Kate Roach, therein. J. H. Mullin, County Judge. i
