That said Henry E. Hart, departed this life testate on the 14th day of December, 1908, <br />in West Blue Township, Adams County, Nebraska, being at the time of his death and for a. long�� <br />I <br />prior thereto, a resident and inhabitant of said Adams County, Nebraska. <br />i <br />4. That on the 16th day of December, 1908, Nella C. Hart, by Jno. Snider, her attorney, filed; <br />in this Court, a paper writing purporting to be the Last Will and Testament of Henry E. Hart, j <br />deceased, also filed petition praying for the probate and allowance of said paper Writing, also <br />i <br />that Letters Testamentary might issue to Della C. Hart, the Executrix named in said Will, <br />b. That on the 16th day of December, 1908, the Court made an order fixing the 2nd day of <br />January, 1909, at 10 o'clock A.M. at the County Court Room, in Hastings, Nebraska, as the time <br />and place for the hearing on said petition, and directed that notice be given by the publication <br />of a copy of said order in the Hastings Tribune, a newspaper printed, published and of general <br />circulation in said County, for three weeks prior to said day of hearing, <br />6. That notice was given by the publication of a copy of said order in the Hastings Tribune, 84s <br />directed, and that proof of the due publication thereof was filed with this Court on the 2d day <br />of January, 1909. <br />7. That on the 2d day of January, 1909, hearing was had and an order was made proving, <br />approving, probating and allowing said paper writing as the Last Will and Testament of said <br />Henry E. Hart, deceased, and directing that Letters Testamentary should issue to Nella C. Hart, <br />upon her giving bond in the sum of $1 000 00 with sureties to be approved by the Court, and <br />taking and filing the oath required by law. <br />8. That on said 2d day of January, 1909, the said Nella C. Hart duly qualified as such Exe- <br />cutrix by giving bond with sureties which were approved by the Court, and taking and filing the <br />oath required by law, and thereupon Letters Testamentary were issued to her, and she entered <br />I <br />upon her duties as such Executrix. <br />I <br />9. That on the 2d day of January, 1909, the Court made an order fixing the 30th day of j <br />January, 1909, at 10 o'clock A.M. at the County Court Room, in Hastings, Nebraska, as the time <br />and place for the filing, examination and adjustment of claims against said estate and directed <br />that all claims not filed on said day so limited, or within six months thereafter, should be <br />forever barred, and further directed that notice be given by the publication of a copy of said <br />order in the Hastings Tribune, a newspaper printed, published and of general circulation in said <br />County of Adams for four weeks prior to said day of hearing. <br />10. That notice was given by the publication of a copy of said order in the Hastings Tribune, <br />as directed, and proof of the due publication thereof was filed with this Court on the 30th <br />day of January, 1909, <br />11. That the time limited for the filing and adjustment of claims against said estate has <br />long since expired and that all claims not filed have become barred by the Statute of Limitation <br />and there are no appeals pending from the disallowance of any claim; and that there remains in <br />the hands of the said Executrix the sum of 33 43. <br />12. That the said Henry E. Hart died seized of the following described real estate, to -wit: <br />The East half (E J) of the Northwest quarter (Nw�) and the Northwest quarter (NW�) of the <br />Northeast quarter (NEJ) of section twenty -seven (27), Township Eight (8), Range Nine (9), West <br />of the 6th. P. M. Adams County, Nebraska, also an undivided one - fourth (�) interest subject to <br />the life estate by curtesy of David Hart, in the Northeast quarter (NE�) of Section thirty -six <br />(36), township nine (9), Range Nine (9), West of the 6th P.M. Hall County, Nebraska. <br />
