IN COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the Matter of the Estate of } <br />FINAL DECREE. <br />William R. McAllister, deceased. ) <br />Now on this 27th day of February, 1909, this cause came on <br />for hearing upon the report of Emma.A. McAllister, Administratrix of the estate of William R. <br />McAllister, deceased, and the petition for final settlement of said estate, and it appearing to <br />the satisfaction of the Court that all persons interested in said estate have been notified, and <br />have entered their voluntary appearance and waived further notice and have requested the Court <br />to approve and allow the account of said Administratrix, and it further appearing to the Court, <br />after a full examination of said account that the same is true and correct in all respects and <br />ought to be allowed, it is, therefore, <br />ORDERED, ADJUDGED AND DECREED that the report of Emma A. McAllister, Administratrix of the <br />estate of William R. McAllister, deceased, be and the same is hereby approved and allowed as and <br />for her final account. <br />The Court finds that by order of Court, entered August 3rd, 1908, creditors of the estate of <br />William R. McAllister, deceased, Were allowed six months from the 10th day of August, 1908, in <br />which to present their claims, duly authenticated, in the office of the County Judge of Hall <br />County, Nebraska ; that the time then allowed for filing claims has fully expired; that notice <br />Was given all persons in the manner provided by law, of the time allowed and place appointed <br />for filing claims; that no claims or demands of any nature Were filed; that all claims outstand- <br />ing against said estate, if any there be, are therefore forever barred and excluded. <br />It is therefore, Ordered, Adjudged and considered that all persons are forever barred from <br />filing or setting up any claims or demands against the estate of William R. McAllister, deceased':, <br />and the same is fully settled. <br />The Court finds that the said William R. McAllister departed this life on the 27th day of <br />July, 1908, and that he died intestate. It is further found by the Court that the said William <br />, <br />R. McAllister left surviving him as his heirs at law, and his only heirs at law, the following <br />named persons:- Emma A. McAllister, his widow, and May A. McAllister, Grace Rieder, Louis A. <br />McAllister, Ruth Stuart Hansen, Harry B. McAllister and Elizabeth McAllister, his children, and <br />that the said Emma A. McAllister is the parent of all of said children. <br />The Court finds that the said William R. McAllister was, at the time of his death, the <br />owner of the following described real estate situate in the County of Hall and State of Nebraska, <br />to -grit: The East 1 -3 of Lot 6 and all of Lot 7, in Block 83, in the Original Town, now City of <br />Grand Island; All of Block 5, in Schimmerts Addition to Grand Island; Lot 5, Block 4, in <br />Windolph's Addition to Grand Island, and that under and by virtue of the laws of the State of <br />Nebraska, all of said real estate did pass and descend as follows:-,• - One- Third (1 -5) part <br />thereof to Emma A. McAllister, to have and to hold to her and her heirs and assigns forever, <br />and the remaining two- thirds thereof to May A. McAllister, Grace Rieder, Louis A. McAllister, <br />Ruth Stuart Hansen, Harry B. McAllister and Elizabeth McAllister, as tenants in common, subject <br />only to the homestead right of the said Emma A. McAllister in and to said real estate. <br />It is therefore, CONSIDERED AND ADJUDGED by the Court that 1 -3 of all of said above <br />described real estate did pass and descend at the death of William R. McAllister, under the law <br />of descent, to Emma A. McAllister, his widow, in absolute title, and that the remaining two- thirds <br />of said real estate did descend to May A. McAllister, Grace Rieder, Louis A. McAllister, Ruth <br />Stuart Hansen, Harry B. McAllister, and Elizabeth McAllister, the children of deceased, in equal <br />shares, to have and to hold to theca and their heirs and assigns forever, subject to the homestead <br />rights of Emma A. McAllister therein. <br />The Court finds the personal property belonging to said estate and listed in the Inventory <br />
