Wartman, the only children and the only heirs at law and <br />devisees of said Schuyler S.Wartman,deceased,and being the only devisees,legatees and heirs at <br />law named in the Last will and testament of said Schuyler S. Wartman and Maggie. Wartman,deceased', <br />i <br />the last will and testament of said Schuyler S. Wartman having been duly admitted to probate and; <br />recorded in the District Court of Iowa in and for Koss1:ith County,on the 18th day of December <br />i <br />1894,other than Maggie Wartman,who was the surviving widow of said Schuyler S. Wartman,and res- <br />pectfully shows to the Court as follows: <br />That upon the probate of the will of the said Schuyler S. Wartman,the said Maggie Wartman was I <br />I <br />duly appointed and thereafter was duly qualified as the executrix of the last will and testamrentl <br />of said Schuyler S. Wartman, and duly acted as such executrix until her death,which occurred <br />rN I <br />on the 26th day of September A.D. 1908. <br />That under the terms and provisions of the last will and testament of said Schuyler S. Wartman, j <br />the said Maggie Wartr�an was duly authorized to manage,proserve and control the estate,real and <br />personal,of the said Schuyler S. Wartman,and to negotiate loans,renew leases,rent and improve { <br />the same,and as such executrix she was authorized and empowered to sell and convey the said real <br />i <br />estate,or any part thereof,at private sale or otherwise,etc. <br />4 <br />That in pursuance of the rights and powers given and conferred by said last will and testament <br />of the said Schuyler S. Wartman the said Maggie Wartman,as such executrix,did manage,control andl <br />handle the estate of said Schuyler S.
