<br />third paragraph of the said will the names of my sons Edison Heitz and George Heitz, and do
<br />give and bequeath to them, and that they shall each inherit and receive under the said will share
<br />and share alike, as tenants in common, with my said children named in the said third paragraph
<br />of the said will, to -wit: William T. Heitz, Louisa Heitz, Frank Heitz, Clara Heitz,and Charlie
<br />Heitz; And that if either oithe said sons, Edison Heitz and George Heitz, shall die in my life
<br />time leaving issue or descendants, I direct that his share shall not lapse but shall be paid and
<br />pass to such descendants in equal proportions.

<br />Now on this 27th day of January, 1910, this cause came on
<br />for hearing upon the report of Amelia Heitz, Executrix of the Last Will and Testai:ient of Theo-
<br />bald Heitz, deceased, and it aDpearing to the satisfaction of the Court, from the proof now on
<br />file, that all persons interested in the estate of said deceased, have been duly notified by
<br />publication, of the filing of said report and of the time and place fixed for the nearing thereon,
<br />and there beinE no objection or protest on file, and it further appearing to the Court, after a
<br />full examination, that said report is correct in all respects and ought to be approved and
<br />allowed, it is, therefore,
<br />Ordered, Adjudved, and decreed that the report of Amelia Heitz, Executrix of the last will
<br />and testament of Theobald Heitz, deceased, be and the same is hereby approved and allowed as and
<br />for her final account and she is discharged of her trust.
<br />The Court finds that notice was given to all persons, in the manner provided by law, of the
<br />time allowed and place appointed for filing claims against said estate; that the time allowed
<br />for filing claims against said estate has fully expired; that all claims filed and allowed
