<br />In the nai;ie of Cod Amen: I, Theobald Heitz of Doniphan, Hall County, Nebraska, considering the;

<br />uncertainty of this mortal life and being of sound mind and memory do make and publish this
<br />my last will and testament, in manner and forr:� following that is to say:
<br />First: I direct that all my funeral expenses, the charges of administering my estate and all

<br />my debts be paid out of my personal property. ,

<br />Second: I give and bequeath to my beloved wife, Amelia Heitz, all the residue of my personal
<br />property of every kind and nature of which I own or am possessed of at the time of my death. I
<br />a ;so give and bequeath to my beloved wife,the South -west quarter (�) of the South -rest Quarter

<br />(} of Section Thirty -four (34), Township Ten (10), N. Range Nine (9), W. the said 40 acres of
<br />land being the one on which the7dwelling house in which we now reside stands, the same to be re-
<br />ceived and accepted by her in lieu of dower, and of any distributive share of my estate.

<br />Third: I give and bequeath the South -east quarter (-L) of the South -West Quarter (µ) of said
<br />Section Thirty -four (34) Township Ten (10), N. Range Nine (9), West, the South -East quarter (4)
<br />of the South -East Quarter (I-) of Section Thirty -three (33) in the said last named township and
<br />range, and the South-west Quarter (4) of the South -Test Quarter (�) of Section Twenty -two (22),

<br />in the said township and range and the North-west Quarter (4) of the North -west Quarter () ,
<br />and the West half Q) of the North -east Quarter (4), in Section Three (3), in Township Nine (9),
<br />W. all in said County and State, and all the residue of my real estate of which I may die seized

<br />to my children, William T. Heitz, Louisa Heitz, Frank Heitz, Clara Heitz and Charlie Heitz, the
<br />same being the children the issue of my ratriage with ray beloved wife Amelia, share and share
<br />alike as tenants in common. In case any of my said children shall die in nay lifetime leaving

<br />issue or descendants I direct that his or her share shall not lapse but shall be paid and pass
<br />to such "descendants in equal proportions.
<br />Fourth: I appoint my wife, &,,elia Heitz, executrix of this my last will and testament hereby
<br />revoking all former wills by rile made.
<br />In Fitness Thereof, I have hereunto subscribed my name this 10th day of July, 1899.
