<br />Charles H. Miller, being first duly sworn, deposes and says, that:
<br />he was the only son of the Emily W. Miller, a copy of whose will is hereto attached, and of the
<br />Samuel T. Uiller, her husband and residuary legatee therein named; that said Emily W. 111iller
<br />was, at the time of her death, to -grit: 7th day Aug. 1903, the owner of the above described prem-
<br />ises, and that, by the terms of said 'dill, the said Samuel T. Miller became the owner thereof;

<br />that said Samuel T. Miller died at Kansas City, Missouri, on or about the 5th day of March,
<br />1904, intestate, and leaving no debts; that at the time of his death he was a widov,er, and that j
<br />the heirs at law and only heirs at law of said Samuel T. Miller are this affiant (Charles H.
<br />Miller) and a grand-son, Holland 3t. Cole, of Lincoln, Nebraska, now of lawful conveying age, and

<br />being the only child of a deceased daughter of said Samuel T. Miller; and that thus the said
<br />Holland R. Cole and this affiant are now the only owners of the above - described premises, and
<br />are about to convey the same to John Allan of Grand Island, Nebraska.

<br />I, Emily W. Miller, of No. 817 E. 13th St., Kansas City, Missouri, considering the cancer-
<br />,
<br />tainty of life and being of sound mind and memory, blessed be God for the same, do make and
<br />publish this my last will and testament, in manner and form following, that is to say:
<br />First':- I direct that my funeral charges and expenses of administring my estate, and all of M$
<br />;
<br />debts be paid out of my personal property. If that be insufficient, I authorize my executor,
<br />hereafter named, to sell so much of my estate as may be necessary for that purpose.

<br />Second: I give and bequeath to my son, Chas. H. Miller, the sum of 1 00. To my grand -son
<br />Holland R. Cole, I give and bequeath $1 00.
<br />Third: I give and bequeath to my beloved husband, Samuel T. Miller, all of my estate, both
<br />personal and real, monieys, chattelS and rights of every kind and nature of which I may die seized.
<br />Fourth: I appoint my beloved husband Samuel T. Miller, Executor of this., my last Will and
<br />Testament, hereby revoking all. former Wills by me made, and I especially request that the
<br />Executor do not be required to give bonds.
